RES-8014 Granting Conditional Use Permit No. 1948-91RESOLUTION NO. 8014 A RESOLUTION OF THB CITY COUNCIL OF THB CITY OF ORANGB UPHOLDING THB RECOMMENDATION OF THE PLANNING COMMISSION OF THE CITY OF ORANGB AN]) GRANTING A CONDITIONAL USE PERMIT TO ALLOW EXPANSION OF A HOSPITAL, A TEMPORARY PARKING LOT AN]) STRUCTURAL HEIGHT IN EXCESS OF TWO STORIES IN OP DISTRICT UPON PROPERTY SITUATED IN THE VICINITY OF MAIN STREET AN]) LA VETA AVENUE. CONDITIONAL USB PERMIT 1948- 91 APPLICANT: CHILDREN'S HOSPITAL OF ORANGE COUNTY RECITALS:After report thereon by the Planning Commission and after due public hearings as required by law, and after receiving a recommendation from the Planning Commission, recommending, by Resolution No. PC-16-92, that Conditional Use Permit 1948-91 be granted to allow expansion of a hospital, a temporary parking lot and structural height in excess of two stories in the OP district upon property situated in the vicinity of Main street and La Veta Avenue, the City Council considered Conditional Use Permit 1948-91, and determined that the recommendation of the Planning Commission should be upheld and Conditional Use Permit 1948-91 be granted. Subject property is more particularly described in Exhibit " A" which is attached herein.During the public hearing, the City Council found the facts as follows:1. That the applicant is requesting approval of Conditional Use Permit 1948-91 to allow an expansion of CHOC Hospital, and the construction and operation of a temporary parking lot. Additionally, the conditional use permit application includes a request to allow structural height in excess of 2 stories in the OP (Office Professional) District.2. That the project is located upon two sites: 1) an irregular shaped site comprised of three parcels totaling approximately 5.1 acres in size and located at the northeast corner of La Veta Avenue and Main Street (455 s. Main street);and 2) a rectangular shaped parcel approximately 3.5 acres in size lot side of Main Street 230 3. That the City's General Plan Land Use Policy Map designates the site located at the northeast corner of La Veta Avenue and Main street "Public Facility" and the site located on the east side of La Veta Avenue 230' south of Main street as GC General Commercial). The zoning classification for the northern site's three parcels are C-3 (Commercial), OP ( Office Professional), and PI (Public Institution) Districts, while the southern parcel is zoned C-2 ( General Commercial).4. That the applicant is proposing to construct three building additions, a five story addition onto the new CHOC Hospital building (located at the north end of Pepper street 200'north of La Veta Avenue), a 4,680 square foot addition on the CHOC West Medical Office building (located at the northeast corner of Main street and La Veta Avenue), and a 1, 316 square foot addition onto the CHOC research tower (located at the southeast corner of Main street and Providence Avenue). The building additions will be used for waiting rooms, restroom, a multi-purpose room, and expanded research labs. The proposed additions are proposed to allow larger space for existing hospital operations, and are not proposed for new operations or enlarging the hospital's staff.5. That the project also includes construction of site improvements for a temporary parking lot on the project's southern parcel. The temporary parking lot will contain 231 parking spaces, 32 spaces for an existing restaurant, and 199 spaces for CHOC employees.6. That implementation of the project will result in the number of parking spaces provided exceeding the Code required 838 parking spaces by 36 spaces.NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange that Conditional Use Permit 1948- 91 be granted for the following reasons:1. The project shall provide services required by the Community.2. The project is subject to conditions that would preserve the general welfare and would prevent deterioration of bordering land uses.BE IT FURTHER RESOLVED that Conditional Use Permit 1948-91 be granted subject to the following conditions:1. Development shall be in substantial compliance with plans as approved by the Planning Commission and on file with the Department of Community Development.2. All building lighting shall be directed to prevent direct illumination onto adjacent properties and public right-of-ways.3. within 2 days of the final approval of the applicant/developer shall deliver to the Planning Division a cashiers check payable to the County Clerk in an amount required to fulfill the fee requirements of Fish and Game Code section 711.4(d) (2) and the County administrative fee, to enable the City to file the Notice of Determination required under Public Resources Code section 21152 14 Cal. Code of Regulations 15075. If the Planning commission determined that there is no potential impact to wildlife resources, the fee shall be $25.00. If the applicant/developer has not delivered the required fees within such 2 day period, the approval for the project granted herein shall be void. 4. That hospital employees using the temporary parking lot shall not be charged parking fees. 5. That prior to issuance of an occupancy permit for the hospital additions, the applicant shall apply for a zone change to change the hospital property from OP (Office Professional) to PI (Public Institution). 6. That the applicant shall apply for a lot consolidation to eliminate any property line that may exist under the hospital building. The lot line consolidation shall be applied for prior to issuance of any occupancy permits. 7. That a deed restriction shall be applied to the site of the temporary parking lot stating that 183 parking spaces shall be provided for the use of CHOC hospital employees. This document shall be reviewed by the City of Attorney and Community Development Department and filed with the County Recorder. 8. Provide City street trees and tree wells along Main street per street Tree Division requirements. Conditions number 9 to 15 shall be complied with to the satisfaction of the Crime Prevention Bureau or as otherwise noted. 9. All structural additions shall comply with the requirements of Municipal Code -Chapter 15.52 (Building Security Standards), which relates to use of security hardware, doors, windows, and exterior parking/ access lighting (Ord 7- 79).Approved products list 4/91" is available for hardware.10. Display a minimum 8" tall address number upon the front of the building, color to contrast to the background upon which it is installed, visible to approaching emergency vehicles on both southbound and northbound Pepper. Should a W. La Veta address number be chosen, then add "W. La Veta" to identify the primary street. Additionally, provide a minimum 8" tall illuminated address number upon an approved sign, located on La Veta, to direct emergency response, visitors, and the public to the location.11. A parking lot attendant shall be assigned to the lot during all hours of intended use. The attendant shall be located in a position to view activity within the boundaries of the lot,3 Reso No. and shall have a telephone immediately available for reporting suspicious activity. The phone shall not be connected to the primary trunk lines of CHOC for 911. 12. The temporary parking lot shall be assigned an address number for reporting crimes. The number shall be clearly posted at the primary Main street entrance using numbers and street name of at least 6 inches in height, contrasting to the sign's background. 13. The parking lots front fencing shall be a maximum of 42" in height when located in the setback area and shall be see through in design. side, and rear fencing shall be a minimum of 6' in height, and shall be maintained in good repair. 14. Landscape plants and trees shall be maintained, and not obstruct visibility into the parking lot from Main street. Additionally, trees shall not obstruct or interfere with the distribution of required parking lot lighting. 15. parking lot lighting shall be approved by the Crime prevention Bureau and shall meet the minimum maintained level of 1 footcandle of light. Lighting shall be operative from dusk till dawn by photocell or approved time clock, and may be turned off only when the empty lot is physically secured against use.conditions 16 to 21 shall be complied with to the satisfaction of the city's Fire Department and other City Departments as noted.16. The building additions shall conform to the orange Fire Department standards for High Rise buildings. Plans and construction must conform to C.C.R. Title 19 and Title 24.17. The Fire Department access roadway shall be provided with a minimum 20' width and a minimum inside turning radius of 20' and outside turning radius of 40'. U.F.C. 10.201 18. Dead-end Fire Department access roads in excess of 150 feet long shall be provided with approved provisions for the turning radius of Fire Department apparatus. U.F.C. 10.207 19. The Fire Department access roadway shall be on all weather driving surface capable of supporting the imposed loads of fire apparatus, 40,000 pounds. U.F.C.10.201 20. Fire access lanes are to be posted and red curbed. Identification of fire lanes must meet city of orange Fire Department standards. 21. All mechanical gates shall be provided with a key- operated override per City of Orange ordinance 9- 84.Conditions number 22 and 23 shall be complied with to the satisfaction of the Department of Public Works, or as otherwise noted.22. Payment of the Transportation System Improvement HESO 8014 Program (TSIP) fee as required by city ordinance. 23. Dedicate and construct street improvements on Main street per city standards. 24. If not utilized, conditional Use Permit 1948-91 shall expire two years after the date of planning Commission approval.ADOPTED this 26th day of May 1992.
