CITY OJ' ORANGB UPHOLDING THE RECOMMENDA-
TIO)J OJ' THE PLANNING COMKISSION OF THE CITY
OJ' ORANGE AND ADOPTING A GENERAL PLAN AMEND-
MENT FOR PROPERTY SITUATBD ALONG SANTIAGO
CREBK WEST OJ' TUSTIN STREET.
GENERAL PLAN AMENDMENT NO. 1-
92 APPLICANT: SANTIAGO CREEK
ASSOCIATES WHEREAS, the Planning Commission has authority per
Section 65358 of the California Government Code to make a
recommendation to the city Council to amend its General Plan~
and WHEREAS, the Planning Commission did hold one
duly advertised hearing on April 20, 1992 for the purpose
of considering General Plan Amendment 1-92 upon
property described
as follows:Lots 1-21 and Lot "A" of
Tract No. 9006 and portions of Lot Nos. 9 and
10 of the A.
B. Chapman Tract.WHEREAS, the Planning Commission, after
consideration of all evidence presented at said hearing, did
recommend approval of said General
Plan Amendment; and WHEREAS, the city council did hold a
duly noticed public hearing on May 12, 1992 and did consider
all evidence presented at
said hearing~ and WHEREAS, in adopting this Resolution,
the City Council acknowledges that the property Owner's application
for a General Plan Amendment, a Zone Change and a
Development Agreement have been processed, heard and voted upon concurrently
in order to facilitate and expedite meaningful review
of and decision-making on those applications rather than dealing with
the Project in an incremental manner. Notwithstanding the
joint action on the application, the city council
has determined that the authorizing Ordinance for the
Development Agreement shall not become effective until the passage of at least
30 days from the date of adoption of this Resolution,
provided that a valid referendum petition is not filed
within said 30-day period.NOW, THEREFORE, BB IT RESOLVED
that the city council hereby approves and adopts General Plan Amendment
1-92 for a 33 acre site located west of Tustin
street, east of Cambridge Street and north of Fairway Drive
from Low Density Residential (2-6 units/ac) and Open
Space to Low Medium Density Residential (6-15 units/ac) Open
Space and General Commercial as shown on Exhibit A
attached and incorporated herein for the following reasons:1. The
increase in residential density over a portion of the project
siteandthedesignationof another
portion
General Commercial, will facilitate retention of a greater
portion of the site as open space than would be likely to occur
otherwise.
2. The proposed general plan amendment classification does
represent a reasonable regulation for the proper and orderly
development of the subject property, compatible with the
surrounding land uses designations~
3. Is in conformity with and will promote public necessity,
public convenience, general welfare, and good land use
practices~
4. will be beneficial to the health, safety, and general
welfare.
