HomeMy WebLinkAboutORD-17-08 Modifying Off-Street Parking and Loading RequirementsORDINANCE NO. 17- 08 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING CHAPTER 17.34 OF THE ORANGE MUNICIPAL CODE TO MODIFY THE CITY'S OFF- STREET PARKING AND LOADING REQUIREMENTS.WHEREAS, the City's parking standards were last updated in 1995; and WHEREAS, in recent years the operating characteristics of land uses such as residential development, churches, and gas stations have evolved in a manner that the City's parking standards have been found, in practice, to have diminished relevance; and WHERAS, the City of Orange desires to provide for adequate parking for all of its land uses to minimize impacts to the quality and character of its neighborhoods and commercial districts related to insufficient parking conditions; and WHEREAS, the City of Orange desires to appropriately size parking spaces in order to maximize the utility of both parking spaces and associated parking lots; and WHEREAS, Ordinance No. 17-08 is exempt from the requirement of the California Environmental Quality Act by the Guidelines of the California Environmental Quality Act under Section 15305 (Class 5, Minor Alterations in Land Use Limitations); and WHEREAS, Ordinance No. 17-08, revising provisions of the Code related to parking standards for residential, church, and gas station parking requirements, special status parking spaces, and parking space dimensions, is found to be consistent with the Circulation Element of the General Plan; and WHEREAS, the Planning Commission conducted a public hearing on July 21, 2008 and determined the proposed amendment is justified and recommends approval thereof; and WHEREAS, the City Council conducted one duly advertised public hearing on September 9, 2008, at which time interested persons had an opportunity to testify either in support of or opposition to the Off-Street Parking and Loading Requirements Ordinance Amendment; and WHEREAS, the City Council believes that the proposed amendment will serve the public health, safety and welfare.NOW THEREFORE, the City Council of the City of SECTION I: Table 17.34.060.A (Required Number of Parking Spaces for Residential Uses) IS hereby amended as follows: USE REQUIRED NUMBER OF SPACES Single-Family Housing and PUD's in R-1 Zone 2 enclosed garage spaces/unit up to 4 bedrooms Districts accessed by a 12 foot wide 20 foot long driveway. For 5 or more bedrooms, 1 additional enclosed space. For bedroom additions to homes built prior to the effective date of Ordinance 17-08, refer to Section 17.34. 020.A.For PUD's, units with 3 or more bedrooms shall provide an additional 1.5 guest parking spaces per dwelling unit. Of this requirement, 1 open parking space may be provided at the residence subject to compliance with Section 17. 16.060.R-2 Zone Districts 2 parking spaces per unit, one of which shall be in an enclosed garage Apartments, Condominiums, and PUDsIIIStudio - 1.2 spaces/unit Multiple Family Zone Districts OneBedroom - 1.7 spaces/ unit Two Bedroom - 2.0 spaces/unit Three or More Bedrooms - 2.4spaces per unit Of the above requirements a minimum of one space per unit shall be covered. A minimum of 0. 2 spaces per unit shall be provided as easily accessible and distinguishable guest parking in addition to the required parking for each unit.Boarding House, Bed and Breakfast Inns 1 space/rentable room, plus any other additional spaces required by the underlying zone Student Housing (Dormitory, Fraternity, 0.5 space/student resident, plus 1 space/each Sorority) resident staff person Trailer Park, Mobile Home Park 2 spaces/unit, (1 of which shall be covered,where at least 2 sides of the carport shall be at a minimum 50% open and unobstructed) plus 1 guest space/3trailers or mobilehomes shall be provided as easily accessible and distinguishable guest parking. Tandem parking is permitted for the mobilehome.2 SECTION II: The "Church, chapel, religious facility, cemetery, mortuary" category and automotive Service and Repair" category in Table 17.34.060.B (Required Number of Parking Spaces for Non-Residential Uses) are amended as follows:USE REQUIRED NUMBER OF SPACES Church, chapel, religious facility, cemetery, 1 space/4 seats, or 1 space/30 sq. ft. of gross mortuary assembly area, whichever is greater (18 inches of continuous bench area = 1 seat)Additional facilities and activities other than the church sanctuary shall be parked on an individual basis in accordance with this section. Shared parking conditions that reflect a staggered occurrence of activities require approval of a conditional use permit.Automotive Uses Service and Repair 3 spaces/service bay for gas stations with service bays, auto repair, body shop, oil change, and smog check and other similar facilities where food, beverages, or sundries are sold on an incidental basis through vending machines or limited display areas representing less than 30 percent of the cashier or waiting area.In the case of gas stations with convenience stores, 2 stalls plus additional parking as required for convemence store. The gas station convenience store parking requirement shall be 1 space/800 sq. ft. of gross floor area. Parking spaces abutting air and water service shall not be included in the total number of parking spaces.Additional parking spaces shall be provided for service bays or car washes associated with gas stations with convenience stores at the ratios identified for such uses in this section.SECTION III:Section 17.34.060.C is hereby amended as follows:C. Handicapped and Special Status Parking. Parking spaces for handicapped persons shall be provided in accordance with Federal and State requirements, and may be included as required parking. Specially designated parking spaces for individuals other than those eligible for handicapped parking per Federal and State requirements will not be counted toward the parking required for an individual use. SECTION IV: Section 17.34.11 a.A is hereby amended to read as follows: A. Open Parking Stall. Open parking stalls shall be not less than nine feet (9') wide and 18 feet long, except when adjacent to a wall which requires a ten foot wide stall. Figure 17.34.11 O.A is also revised accordingly. SECTION V: Section 17.34.130.E is hereby amended to read as follows: E. Striping. All required parking shall be clearly outlined on the surface of the lot with paint or easily distinguishable material. Stripes shall be a minimum of four inches wide and in double stripe formation with a 14-inch space between stripes Figure 17.34.130.E). Parking stall widths shall be measured from the centerline between the double striping.Figure 17.34.130.E is also revised accordingly.SECTION VI:Section 17.34.130.F is hereby amended to read as follows:F. Wheel Stops. Wheel stops are only required for angled or perpendicular parking spaces abutting pedestrian walkways but may also be used elsewhere. When used, wheel stops shall be placed a minimum of 34 inches from the front end of the parking stall.SECTION VII:A summary of this Ordinance shall be published and a certified copy of the full text of this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to the City Council meeting at which this Ordinance is to be adopted. A summary of this Ordinance shall also be published once within fifteen (15) days after this Ordinance' s passage in a newspaper of general circulation, published, and circulated in the City of Orange. The City Clerk shall post in the Office of the City Clerk's a certified copy of the full text of such adopted Ordinance along with the names of those City Council members voting for and against the Ordinance accordance with Government Code Section 36933. This Ordinance shall take effect thirty (30) days from and after the date of its final passage.Immediately after the effective date of this Ordinance the City shall include summary of the adopted Ordinance in a general mass mailing, such as the City water bill, to its citizens.
