08 AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF ORANGE APPROVING
THE AMENDED ARCHSTONE GATEWAY
SPECIFIC
PLAN APPLICANT: ARCHSTONE
COMMUNITIES WHEREAS, Orange Municipal Code Section17.26.030 requires an application for
a zone change to the Planned Community (PC) designation be accompanied by a Specific
Plan SP);
and WHEREAS, on May 10,2005, the City Council of the City of Orange (City
Council)adopted Ordinance No. 8-05, adopting Zone Change 1215-
02, which reclassified approximately 12.37 acres of property from Light Manufacturing (
M-l) to Planned Community-Specific Plan (PC-SP) thereby creating
the Archstone Gateway Specific Plan; and WHEREAS, Archstone Communities (Applicant)
hereby desires to amend the adopted Specific Plan to allow condominiums as a permitted use,
as contained in
Tentative Tract Map No. 17141; and WHEREAS, Orange Municipal Code Section 17.
26.040 provides for amendments to Specific Plans adopted in conjunction with a PC zone
designation
to be amended by ordinance;and WHEREAS, the City Council is authorized
by Government Code Section 65453 to amend a specific plan by ordinance as often as deemed
necessary by the legislative body; and WHEREAS, the proposed amended
Archstone Gateway Specific Plan is consistent with California Government Code Section 65451 in
content, including a statement of the relationship of the Specific Plan to
the City's General Plan; and WHEREAS, the City Council finds and
declares that the proposed amended Archstone Gateway Specific Plan is consistent with California Government
Code Section 65454 in that it is consistent with the
City's adopted General Plan; and WHEREAS, the City Council has
considered the Addendum to Final Environmental Impact Report No. 1707-02 (FEIR) and
all accompanying documents, and concludes that in their independent judgment the conversion
of the project from apartments to condominiums will not result in any significant environmental impacts
that have not already been addressed in the FEIR, including the amended specific plan
and any entitlements, such as Tentative Tract Map No. 17141, required to facilitate this change.
The City Council also finds that because none of the conditions described in Section 15162
of the CEQA Guidelines have occurred, the preparation of an Addendum to the FEIR is
appropriate and consistent with
WHEREAS, the City Council has approved and adopted the Addendum to FEIR 1707-
02 and made the necessary findings as it fully set forth in the accompanying resolution
Resolution No. 10265); and
WHEREAS, the City Council has approved Tentative Tract Map No. 17141 and made
all the necessary findings as fully set forth in the accompanying resolution (Resolution No.
10265); and
WHEREAS, the City Council held a duly advertised hearing on March 11, 2008 for the
purpose of considering the various applications and documents described above as well as the
Amended Archstone Gateway Specific Plan for the property shown in the attached Exhibit B.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE
DOES ORDAIN AS FOLLOWS:
SECTION I:
The previously adopted Archstone Gateway Specific Plan is hereby amended as
contained in Exhibit A, attached hereto and incorporated herein as if fully set forth.
SECTION II:
The proposed amended Archstone Gateway Specific Plan described in Section I is
related to the public welfare, furthers the objectives and policies of the City's General Plan,
and is consistent with the approval of Tentative Tract Map No. 17141, and all the necessary
findings, as fully set forth in the accompanying resolution (Resolution No. 10265), which is
incorporated herein by reference as if fully set forth.
SECTION III:
A summary of this ordinance shall be published and a certified copy of the full text of
this ordinance shall be posted in the Office of the City Clerk at least 5 days prior to the City
Council meeting at which this ordinance is adopted. A summary of this ordinance shall also be
published once within 15 days after the ordinances passage in a newspaper of general
circulation, published, and circulated in the City of Orange. The City Clerk shall post in the
Office of the City Clerk a certified copy of the full text of such adopted ordinance along with
the names of those City Councilmembers voting for and against the ordinance in accordance of
Government Code Section 36933. This ordinance shall take effect 30 days from and after the
date of its final passage.
