RES-7986 Granting Conditional Use Permit No. 1930-91RESOLUTION NO. 7986 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE UPHOLDING THE RECOMMENDATION OF THE PLANNING COMMISSION OF THE CITY OF ORANGE AND GRANTING A CONDITIONAL USE PERMIT TO ALLOW THE DEVELOPMENT OF AN AUTOMOTIVE CENTER CONSISTING OF SERVICE AND REPAIR USES SUCH AS LUBE/OIL CHANGE, CAR WASH, TIRE SHOP, AND AN EXISTING SERVICE STATION UPON PROPERTY SITUATED AT THE NORTHEAST CORNER OF CHAPMAN A VENUE AND W A YFIELD STREET. CONDITIONAL USE PERMIT 1930- 91 APPLICANT: ROBERT A. SMITH RECITALS:After report thereon by the Planning Commission and after due public hearings as required by law, and after receiving a recommendation from the Planning Commission,recommending, by Resolution No. PC-48-91, that Conditional Use Permit 1930-91 be granted to allow the development of an automotive center consisting of service and repair uses such as lube/oil change, car wash, tire shop, and an existing service station upon property situated at the northeast corner of Chapman Avenue and Wayfield Street, the City Council considered Conditional Use Permit 1930-91 in conjunction with Zone Change 1141-91 and determined that the recommendation of the Planning Commission should be upheld and Conditional Use Permit 1930-91 be granted. Subject property is more particularly described in Resolution No.PC-47-91 approving Zone Change 1141-91.During the public hearing, the City Council found the facts more particularly described in Resolution No. PC-47-91 approving Zone Change 1141-91.NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange that Conditional Use Permit 1930-91 be granted for the following reasons:1. The proposed project will provide services which are required by the community. 2. The proposed project is compatible with the existing commercial uses in the surrounding neighborhood.3. The proposed project BE IT FURTHER RESOLVED that Conditional Use Permit 1930-91 be granted subject to the following conditions:1. If not utilized, Variance 1916-91 shall expire two (2) years from date of approval.2. Prior to issuance of Building Permits, final landscaping plans shall be approved by the Design Review Board.3. Street trees shall be provided as required by the Department of Community Services.4. Dedicate and construct necessary improvements along Chapman Avenue per City Master Plan of Streets and Highways. Dedication shall occur prior to issuance of building permits. Subject to approval by the City Engineer, surety may be posted to defer construction of improvements until said improvements are warranted.5. Prior to issuance of Building Permits, grading plans shall be approved by the Department of Public Works.6. Prior to approval of grading plans, applicant shall submit the project' s "Best Management Practices" showing conformance to National Pollution Discharge Elimination Systems requirements for approval.7. Prior to issuance of Building Permits, a reciprocal access and parking easement shall be recorded in the County Recorders Office. Such document shall be approved by the City Attorney prior to recordation. A copy of such document shall be kept with this file.8. Subject to paying all development fees and charges in effect at the time of issuance of building permits, including the following:A. Transportation Systems Improvement Program Fee B. Fire Facility Fee C. Police Facility Fee D. School Development Fee Conditions #9 - 21 shall be complied with to the satisfaction of the City's Fire Department:9. An approved fire sprinkler system must be installed throughout the building per O.M. C.15.32.080 section 10.306, Table 1O.306(a). The system shall be designed per N.F.P. A.13, U.B.C. Chapter 38 and U.B.C. Standard 38-1. The sprinkler system requires 24 hour supervision.10. The Fire Department connection shall not be affixed to the building. The Fire Department connection must be located at least 40 feet away from the building, within 40 feet of fire hydrant, and on the address side of the building.Reso.7986 11. Provide on-site fire hydrants and mains capable of supplying the required fire flow. The hydrant model and on-site location shall be approved by the Fire Department and have a three (3) foot minimum clearance around the circumference of the fire hydrant. The on-site hydrants shall not be controlled by the controlvalve (P.I.V.) for the sprinkler system so that water flow to hydrants is not impaired should the sprinkler system be shut down for any reason. U.F.C. 10.206 and 10.301.12. Every building shall be accessible to Fire Department apparatus by an access roadway of not less than 20 feet of unobstructed width having a minimum of 13 feet 6 inches of vertical clearance. The access roadway shall be extended to within 150 feet of all portions of the exterior walls of the first story of any building. U.F.C. 10.207 13. Provide a secondary emergency access that is built and maintained in accordance with U.F.C. 10.207. O.M.C. 15. 32.110 14. The Fire Department access roadway shall be an all weather driving surface capable of supporting the imposed loads of fire apparatus. U.F.C. 10.207 15. The Fire Department access roadway shall be provided with adequate turning radius for Fire Department apparatus. (A 40 foot outside radius is a minimum under most circumstances.) U.F.C. 10.207 16. Fire Department emergency access must not exceed 12 percent grade. The total width must be continuously paved to accommodate 40,000 pounds and shall not exceed the angle of departure for fire apparatus on any slope.17. Fire access lanes are to be posted and red curbed. The sign which restricts parking shall be not less than 17 x 22 inches in size with lettering not less than one inch in height.The sign may also indicate that a citation may be issued for parking violations (C. V.C.22658). The sign shall say "NO PARKING - TOW AWAY" and " UNAUTHORIZED VEHICLES WILL BE TOWED AWAY AT VEHICLE OWNERS EXPENSE". The sign or signs shall display the telephone number of the City of Orange Police Department, (714)744-7444. The sign shall also display the California Vehicle Code C.V.C. 22658 and O.M.C. Sec. 15. 32.010 18. One 2A lOBC rated fire extinguisher shall be provided for every 3000 square feet of the building or 75 feet of travel distance. U.F.C. Standard 10-1 19. The installation of underground tanks, sumps, containers, etc. used for the storage of hazardous materials is regulated by the Fire Department. A Fire Department permit application must be completed and plans submitted to the Fire Department for approval prior to installation. O.M.C. 15.32.135; Cal. Health & Safety Code Sec. 25280; 1982 U.F.C. Article 79 Contact the Hazardous Materials division at (714)288-2541 20. Liquefied petroleum gas container shall be installed as per Uniform Fire Code Section 82. This code section relates to tank size, distances from buildings and property lines, crash post requirements, labeling, pump type, required zoning approval, and Fire Department permit issuance. 21. Businesses storing, handling, or using more than 55 gallons, 500 pounds, or 200 cubic feet of a hazardous material during anyone year, must comply with the disclosure requirements of Ordinance 40-85. O.M.C. 15.32.136 Contact the Hazardous Materials Division at (714) 288-2541 Conditions #22 - 27 shall be complied with to the satisfaction of the City's Crime Prevention Bureau:22. All structure shall comply with the requirements of Municipal Code - Chapter 15.52 Building Security Standards, Ord. 7-79), which relates to hardware, doors, windows,lighting, etc. Approved structural drawings shall include sections of the security code that apply. Specifications, details, or security notes may be used to convey the compliance. This will be reviewed in Plan Check by the Crime Prevention Bureau prior to approval.23. Provide Crime Prevention Bureau with lighting photometric for required parking areas.This shows compliance with the minimum maintained one footcandle. Point to point, or contour analysis is accepted along with the data sheets, showing the luminaires,model/wattage/ height.24. An illuminated address of minimum 8 inches in height is required. Such address shall be contrasting to the background and visible to approaching vehicles. (Location to be determined during the Plan Check process)25. Freestanding signs shall display address of minimum 8 inches in height. Such address shall be illuminated and contrasting in color in a location not obstructed by landscaping or cars. Such sign shall be approved by the Crime Prevention Bureau and the Design Review Board.26. All landscaping shall be maintained so that it does not interfere with the required addressing or areas that are required to be illuminated.27. Perimeter fencing shall be provided along the east and north property lines. Such fencing shall be a non-climbable design, minimum 6 feet in height, and of a solid construction.28. Subject to applicant obtaining approval of the traffic commission and the City Council,left turns shall be allowed from southbound Way field Street to Chapman provided that left turns from the two existing driveways at the Mobil property be restricted with right turns only permitted.Reso.7986 ADOPTED this 14th day of April 1992.
