A RESOLUTION OP THE CITY COUNCIL OP THE
CITY OP ORANGE MODIPYING THE RECOMMENDATION
OP THE PLANNING COMMISSION OP THE CITY OP
ORANGE AND GRANTING A CONDITIONAL USE PERMIT
TO ALLOW EXPANSION OP AN EXISTING RESIDENTIAL
ACCESSORY STRUCTURE IN THE C-1 ZONE WITH
AMENDED CONDITIONS UPON PROPERTY SITUATED AT THE
NORTH-EAST CORNER OP PALM AVENUE AND CLEVELAND
STREETS.CONDITIONAL USE PERMIT

Thibault RECITALS:After report thereon by the Planning Commission
and after due public hearings as required by law, and after
receiving a recommendation from the Planning Commission,
recommending, by Resolution No. 16-57-91, that
Conditional Use Permit 1937-91 be granted to allow
expansion of an existing residential accessory structure in the C-
1 Zone upon property situated at the northeast corner of
Palm Avenue and Cleveland street, the City Council
considered Conditional Use Permit 1937-91 and determined
that the recommendation of the Planning commission should
be modified by amending conditions of approval.Subject
property is
more particularly described in Resolution No. PC-57-91.
During the public hearing, the City Council found the facts
as presented in
the Planning Commission Staff Report and Resolution No. PC-57-
91.However, the City Council found that the imposition
of a condition requiring the applicant to record a deed restriction
to restrict the use of an accessory structure is
not needed due
to the existence of municipal regulations which adequately restrict such use.
NOW, THEREPORE, BE IT RESOLVED by the City Council of
the City of orange
that Conditional Use Permit 1937-91 be granted for the following
reasons:1. The existing use of the property as
a single family residence is compatible with the existing residential
uses in the surrounding area, which
consist of a mixture of mostly single family residences, duplexes, and
apartments.2. The existing use of the property as a single
family residence is consistent with the city's General
Plan
Land Use designation of Low Density Residential (2-6
dwelling units per acre) .BE IT PURTHER RESOLVED
1. If not utilized, Conditional Use Permit 1937-91
shall expire two (2) years from the date of
approval.2. Prior to issuance of Building Permits, final
building elevations shall be reviewed and approved by the Design
Review
Board.3. street trees shall be provided as required by
the Department of Community
services.ADOPTED this 24th day of March
