RES-7977 Approving Pre-Zone Change No. 1145-91RESOLUTION NO. 7977 A RESOLUTION OF THB CITY COUNCIL OF THE CITY OF ORANGB UPHOLDING TJIB RECOJOlENDATIONS OF THE PLANNING COHKISSION OF THB CITY OF ORANGB AND APPROVING TJIB RECLASSIFICATION OF PROPERTY SITUATBD ON THE EAST SIDB OF MEADS AVENUE AT THE NORTBBAST AND SOUTHEAST CORNBRS OF MEADS AVENUE AND ACRE PLACB. PRE-ZONE CHANGE 1145-91 APPLICANT: CITY OF ORANGB RECITALS:After due public hearings as required by law, the City council of the City of Orange considered a recommendation of the Planning Commission of the city of Orange recommending by Resolution No. PC 54-91, that certain property situated on the east side of Meads Avenue at the northeast and southeast corners of Meads Avenue and Acre Place, be reclassified from the County Estate Residential District to the City R-1-40 District, and approved said recommendation after finding and determining the hereinafter described facts. The real property which is the subject of the reclassification is more particularly described in Exhibit A.Upon the public hearing before the City council, the following facts were established:SITE LOCATION AND DESCRIPTION:1. Four parcels of land with a combined area of 4.6 acres located on the east side of Meads Avenue at the northeast and southeast corners of Meads Avenue and Acre Place, a private road, addressed 20292, 20321, and 20312 Acre Place. One parcel is vacant and does not have an address assigned.REOUEST:2. Pre-zone change of four residential lots from County estate residential to City R-1-40 (single family residential minimum lot size one acre) district prior to annexation to the city. Orange Municipal Code section 17.06.100 permits the pre- zoning of property prior to annexation into the City subject to public hearing before both the Planning Commission and city Council.BACKGROUND: 3. Existing site development consists of a single family residence on each of the addressed parcels with the parcel located at the northeast corner of Meads\Avenue and Acre Place vacant. site access is from Acre 4. On September 10, 1991, the City council adopted Resolution No. 7881, authorizing an agreement with the County to redistribute property taxes as required with annexation of the project site into the City of Orange. If the County Board of Supervisors approves this Resolution, the annexation request will be forwarded to the Local Agency Formation Commission (LAFCO) for determination. After determination by LAFCO, the annexation request is returned to the City for final approval. 5. The annexation request was initiated by the property owner of 20292 Acre Place who was encouraged by staff to include the adjoining properties in the proposal in order to comply with LAFCO policies of decreasing the size of county islands and squaring off city boundaries. The owners of 20321 and 20312 connected to the City sewer system in 1983. At that time they signed an annexation agreement and paid a deposit which was forfeited because annexation did not occur by 1988 as specified in the agreement. Annexation was not possible at that time since the parcels did not have a common city boundary. 6. Meads Avenue is a rural local street with a 45 foot right of way. As indicated on the annexation map accompanying this zone change request, the proposed City boundary line will extend to the centerline of Meads Avenue. 7. The project site is bordered by single family residences on the north, east and west across Meads Avenue within the County. South of the site is the Ridgeline Country Club located within the City and zoned R-O Recreation Open Space.DEVELOPMENT PROPOSAL:8. No expansion of the existing residential improvements is proposed with this zone change request. The owner of 20292 Acre Place is currently in the process of remodeling the residence and ultimately plans to connect to the City sewer system at a later date. Development of the vacant parcel is not proposed at this time. ANALYSIS:9. Each of the subject parcels contains at least one acre and is in conformance with R-1-40 lot dimension and area requirements. The approximate area of each parcel is as follows: Lot 1 (vacant) 1.1 acres, 20321 Acre Place 1.0 acres, 20312 Acre Place 1.0 acres, 20292 Acre Place 1.2 acres,road easement 0.3 acres total area 4.6 acres.10. The site is in conformance with the General Plan estate low density residential land use designation (0-2 units per acre) and is in conformance with the Orange Park Acres Plan. The City's R-1-40 zone has essentially the same lot area and development standards as the County's estate resi-dential designation. Consequently, no change in land use will occur with the proposed zone change and no negative impact to surrounding property is anticipated.11. The Environmental Review Board examined the proposed project at their October 9, 1991 meeting and expressed no concerns with the zone change request. In conformance with Orange Park Acres Plan goals intended to preserve and enhance the rural atmosphere of the area, street dedication, lighting or other improvements will not be required by the Public Works Department for this project. During their review of subse-quent development plans for the vacant parcel, the Public Works Department will determine whether street dedication,lighting, or other improvements are necessary at that time.The improvements required will be the minimum necessary to ensure public safety while also preserving the rural environ-ment of the area. City services are adequate to support existing and potential future site development under the proposed zoning designation.NOW, THEREFORE, BE IT RESOLVED by the city Council of the City of Orange that the recommendation of the Planning Commission be upheld and that Pre- Zone Change 1145-91 reclassifying the subject property to the R-1-40 District be approved for the following reasons:1. The proposed project is in conformance with General Plan Land Use Policy Goals for the site and in conformance with the Orange Park Acres Plan.2.
