RES-7960 Authorizing Destruction of Certain City RecordsRESOLUTION NO. 7960 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE AUTHORIZING THE DESTRUCTION OF CERTAIN CITY RECORDS, DOCUMENTS, AND PAPERS IN THE POSSESSION OF THE POLICE DEPARTMENT AND WHICH RECORDS ARE NO LONGER REQUIRED FOR THE CONDUCT OF CITY BUSINESS PURSUANT TO THE AUTHORITY GRANTED BY SECTIONS 34090, 34090.5, AND 34090.7 OF THE GOVERNMENT CODE OF THE STATE OF CALIFORNIA. WHEREAS, the Government Code of the State of California authorizes the destruction of city Records, documents, or papers upon the approval of the legislative body of the city, and with the written consent of the city Attorney, provided that said records are not included within certain exempt categories; and WHEREAS, the Chief of Police of the City of Orange has requested authority to destroy certain records of complaintsagainstpoliceemployeesofthecityoforange; and WHEREAS, the Chief of Police of Police of the City of Orangehasrequestedauthoritytodestroycertainotherrecords, documents, and papers; and WHEREAS, none of the above records are included within said categories of documents enumerated in Section 34090 of the Government Code of the State of California as being exempt from destruction; and WHEREAS, all records or complaints against police employeesofthecityofOrangehereinafterlistedwerepreparedonadate at least five (5) years prior to the date of this Resolution; and WHEREAS, the Chief of Police has reviewed said records and has determined that such complaints against police employees,after investigation, are related neither directly or indirectly to any civil litigation currently in process; and WHEREAS, the Chief of Police of the city of Orange has determined that none of the hereinafter described records have sufficient value to justify retention; and NOW THEREFORE, BE IT RESOLVED by the city Council of the City of Orange that the following records are no longer requiredbytheCityofOrangeandmaybedestroyed. Said records are more particularly described as follows: 1. Records of complaints against personnel of the City ofOrangePoliceDepartmentwheresaidrecordsaremorethanfive (5) years old, except those which relate, directly or indirectly, to any litigation currently in progress. 2. Background investigation files developed five'(5) or more years prior on candidates who were never employed. 3. Timekeeping records (ledgers, leave slips, overtimeslips, miscellaneous correspondence) dated five (5) or more yearsprior, except those which relate, directly or indirectly, to anylitigationcurrentlyinprogress. 4. Department Reports of Events (DR's) dated seven (7) or more years ago. Hardcopy files only - files on microfilm to be retained.5. Department Check Reports (Check DR's) dated three (3) or moreyearsprior.6. Traffic Accident Reports dated three (3) or more years prior.7. Officers and Supervisors Activity Logs dated three (3)or more years prior.8. Carbon copies of traffic citations dated two (2) or more years prior.9. Bail Receipt carbon copies dated two (2) or more years prior. Originals retained in Court files.10. Miscellaneous receipts for financial transactions fingerprintfees, vin verifications, and other transactions with nocasefile) dated two (2) or more years prior.11. Miscellaneous register logs (ambulance, DR number issue logs) dated two (2) or more years prior.12. Miscellaneous correspondence, including Police Clearance Letters, and Division miscellaneous records dated two (2) or more years prior.13. Administrative Budget Records dated three (3) or more years prior.14. Those written requests for access to criminal history informationmaintainedbythestate (Rap Sheets), where there is nocasefile, dated three (3) or more years prior.Reso No. 7960 2- BE IT FURTHER RESOLVED, that the proper official of the City of orange having custody of the above-described records,documents, and papers is hereby authorized to destroy said records, documents and papers in a lawful manner as scheduled.BE IT FURTHER RESOLVED, that upon destruction of the aforementioned and described records, documents and papers, a certificate of destruction shall be executed as to the documents destroyed and the original thereof filed in the Office of the City Clerk together with a copy of this Resolution.BE IT FURTHER RESOLVED, that this Resolution shall be effective as of March 10, 1992 and shall remain in full force and effect applying to all said records reaching the requisite age, unless otherwise specifically directed by the city Council.All such records hereafter reaching the requisite age shall be clearly identified to the city Attorney, who shall consent in writing prior to their destruction.ADOPTED this 10th of March 1992. eJ4~ ATTEST:ijn':: Vd..~ C.;) (;;h"/ 41f' .?~city Clerk f t~ c1tY of Orange I hereby certify that the foregoing regularly adopted by the City Council of regular meeting thereof held on the 10th by the following vote:Resolution was duly and the city of Orange at a day of March , 19 ~AYES: COUNCIL MEMBERS: STEINER, BARRERA, MAYOR BEYER, COONTZ, SPURGEON NOES: COUNCIL MEMBERS: NONE ABSENT: COUNCIL MEMBERS: NONE ABSTAIN: COUNCIL MEMBERS: NONE n -' A~./ _1..1. ~filj?r--- city Clerk~f t.
