A RESOLUTIOH OF THE CITY COUNCIL OF
THE CITY OP ORANGE ESTABLISHIHG
UNDERGROUND UTILITY DISTRICT HO. 12.
WHEREAS, the City Engineer prepared and submitted to
the City Council that certain document entitled, "Engineer's
Report, Underground Utility District No. 12," dated
February, 1992; and
WHEREAS, on January 14, 1992, the City Council adopted
Resolution No. 7932 setting February 25, 1992, as the date
of public hearing to ascertain whether the public necessity,
health, safety, and welfare requires the removal of poles,
overhead wires and associated overhead structures within
that area of the City generally located on The city Drive
from Route 22 Freeway to approximately 2,200 feet north, and
to consider the underground installation of the
aforementioned appurtenances for supplying electric,
communication or similar associated services to the
residents of the City of Orange; and
WHEREAS, in accordance with Orange Municipal Code
Chapter 12.44, the City Clerk gave notice of time and place
of such public hearing to all affected property owners as
shown on the last equalized assessment roll and also to all
concerned utilities by mail to determine whether to form an
underground utility district; and
WHEREAS, such hearing was duly held at the 7:00 p.m.
session of the Council meeting of the 25th day of February,
1992, and all interested persons were given an opportunity
to be heard; and
WHEREAS, the city Council finds and determines that the
public necessity, health, safety and welfare require the
removal of poles, overhead wires and associated overhead
structures and the installation underground of the
aforementioned appurtenances in proposed Underground Utility
District No. 12; and
WHEREAS, the City Council finds that such under-
grounding complies with the criteria and findings required
by Public utilities Commission, Rule No. 20A.
HOW, THEREFORE, BE IT RESOLVED by the City Council of
the city of Orange as follows:
1. That pursuant to section 12.44.050 of the Orange
Municipal Code, the area particularly described in Exhibit
A" and shown on the map in Exhibit "B", said exhibits being
attached hereto and made a part hereof, are hereby declared
to be added and annexed into Underground Utility District
No. 12 of the City of Orange which the City Council hereby
declares to be established.
2. That the City Council does hereby order the
removal of poles, overhead wires and associated overhead
structures and the underground installation of wires and
facilities for carrying electric, communication or similar
or associated service within said area on or before October
1, 1992.
3. That each property served from such overhead
facilities shall have installed underground services in
accordance with the utility companies' rules for underground
service and shall have made changes on the premises neces-
sary to receive services from the underground facilities of
the utility companies.
4. That the City Council does hereby authorize the
utility companies to discontinue their overhead services to
such properties if they are not ready to receive services
underground within thirty (30) days of notification by the
city Engineer.
5. That the city Clerk is hereby instructed to notify
all affected public utilities and persons owning real
property within the herein described area of the
establishment of Underground Utility District No. 12 by the
adoption of this Resolution within ten (10) days after the
date of its adoption. The City Clerk shall further notify
said property owners of the necessity that, if they or any
person occupying such property desires to continue to
receive electric, communication or similar or associate
service, they or their occupants shall, by October 1, 1992,
provide all necessary utility changes on their premises so
as to receive such service from the lines of the supplying
utility or utilities at a new location, subject to appli-
cable rules and regulations of the respective utility or
utilities on file with the Public utilities Commission of
the state of California. Such notification shall be made by
mailing a copy of this Resolution together with a copy of
Chapter 12.44 of the Orange Municipal Code to all affected
property owners as such are shown on the last equalized
assessment roll and to the affected utilities.
BE IT FURTHER RESOLVED that Exhibit "B", being a map of
Underground utility District No. 12, shall not be published.
