A RESOLUTXOH OF THE CXTY COUNCXL OP THE

OF AN XKPARTXAL ANALYSXS, AND WRXTTEH
ARGUKEftS. (BALLOT MEASURE REGARDXHG
APPOXftKEllT OF CXTY TREASURER)
RESOLVED, by the city council of the city of Orange,
California (the "city"), that
WHEREAS, on this date, this city Council has adopted a
resolution entitled "A Resolution of the city council of the City
of orange calling and giving notice of the holding of a special
municipal election to be held on Tuesday, June 2, 1992, for the
submission of the question to the electors of whether the present
elective office of city Treasurer should be an appointive office
with the City Treasurer to be appointed by the City council,"
ordering the submission of a proposition to the qualified voters
of the city (the "Resolution"); and
WHEREAS, this City Council desires that the special
municipal election provided for in the Resolution be consolidated
with the general election to occur on June 2, 1992, in the
territory of the City and that said proposition be included on
the ballot for said election which ballot is prepared by the
Orange County Registrar of Voters; and
WHEREAS, Section 5011 of the California Elections Code
authorizes the filing of an impartial analysis and Sections 5013
and 5014.5 of said Code authorize the filing of written arguments
for or against any ballot proposition, and, if adopted by the
city council, rebuttal arguments.
HOW, THEREPORE, BE XT RESOLVED by the city council of the
city of Orange as follows:
Section X:
The Board of supervisors of the County of Orange is hereby
requested to permit the Orange county Registrar of Voters to
provide such services as may be necessary to properly and
lawfully hold and conduct a special municipal election in the
City on June 2, 1992, pursuant to the Resolution, including but
not restricted to the providing and printing of ballots and
polling place cards, election supplies, voting booths, flags,
registration lists and any other materials and services required
to lawfully conduct the election.
Section XX:
For its approval and signature this city council hereby
directs the city Manager and his staff to prepare and file a
written argument for the proposition to be submitted at said
special municipal election. said written argument for the
proposition shall not exceed 300 words in length. The city
Council hereby adopts the provisions of Subdivision (a) of
section 5014.5 of the California Elections Code. If any person
submits an argument against said proposition, the City Manager
and his staff shall prepare, for the approval and signature of
this council, a rebuttal argument not exceeding 250 words. The
arguments and rebuttal shall otherwise conform to and comply with
all applicable provisions of the California Elections Code. The
deadline date for the submittal of arguments, in favor or in
opposition, shall be February 21, 1992.
section III:
The city Clerk is hereby directed to submit to the city
Attorney a certified copy of the Resolution. The City Attorney
is hereby authorized and directed to prepare an impartial
analysis of the proposition specified in the Resolution showing
the effect of the measure on the existing law and the operation
of the measure, said analysis to be submitted by the City
Attorney to the City Clerk and to the Registrar of Voters or
other appropriate officer of Orange County for printing before
the arguments for and against the measure. The analysis shall
not exceed 500 words in length and shall otherwise comply in all
respects with the applicable provisions of Section 5011 of the
California Elections Code. The deadline date for the submittal
of the analysis shall be February 21, 1992.
Section IV:
The city Clerk is hereby directed to file with the Board of
supervisors of Orange County a certified copy of this Resolution
and of the Resolution mentioned hereinabove on or before March 6,
1992.
