RBSOLVED, by the City Council of the City of Orange, (the City"), that WHBREAS, on this date, this City Council has introduced and had the first reading of an ordinance entitled "An Ordinance of the City Council of the City of Orange OrderingtheSubmissionofaPropositionofIncurringBondedDebtfor the Purpose of the Acquisition and Improvement of Real PropertyLyingGenerallyAlongSantiagoCreekBetweenHartParkand Tustin Street for Open Space or a Municipal Park to the Qualified Voters of the City of Orange at an Election to be Held for that Purpose", ordering the submission of a proposition to the qualified voters of the city (the Ordinance"); and WBBRBAS, this City Council desires that the specialmunicipalelectionprovidedforintheOrdinancebe consolidated with the general election to occur on June 2, 1991, in the territory of the City and that said proposition beincludedontheballotforsaidelectionwhichballotis prepared by the Orange County Registrar of Voters; and WHBRBAS, Section 5011 of the California Elections Code authorizes the filing of an impartial analysis and Sections 5013 and 5014.5 of said Code authorize the filing of written arguments for or against any ballot proposition, and, if adopted by the City Council, rebuttal arguments; and IIOW, TBBREFORE, BB IT RESOLVED by the City Council of the City of Orange as follows: Section I: The Board of Supervisors of the County of Orange is herebyrequestedtopermittheOrangeCountyRegistrarofVotersto provide such services as may be necessary to properly and lawfully hold and conduct a special municipal election in the City on June 2, 1991, pursuant to the Ordinance, including but not restricted to the providing and printing of ballots and polling place cards, election supplies, voting booths, flags,registration lists and any other materials and services required to lawfully conduct the election. Section II: The City Council hereby adopts the provisions of subdivision (a) of section 5014.5 of the California Elections Code. The arguments and any rebuttals shall conform to and comply with all applicable provisions of the California Elections Code. The deadline date for the submittal of arguments of not more than 300 words, in favor or in opposition, shall be February 21, 1992. Rebuttal arguments shall not exceed 250 words. Section III: The city Clerk is hereby directed to submit to the city Attorney a certified copy of the ordinance. The city Attorney is hereby authorized and directed to prepare an impartial analysis of the proposition specified in the Ordinance showing the effect of the measure on the existing law and the operation of the measure, said analysis to be submitted by the city Attorney to the city Clerk and to the Registrar of Voters or other appropriate officer of Orange County for printing before the arguments for and against the measure. The analysis shall not exceed 500 words in length and shall otherwise comply in all respects with the applicable provisions of section 5011 of the California Elections Code. The deadline for the submittal of the analysis shall be February 21, 1992. section IV: The City Finance Director is hereby authorized and directed to prepare, or cause to be prepared, the statement with respect to the proposed bond issue required under section 5301 of the california Elections Code, and to submit said statement to the city Clerk no later than February 21, 1992. section V: The city Clerk is hereby directed to file with the Board of Supervisors of Orange County and the County Registrar of Voters a certified copy of this Resolution and of the Ordinance on or before March 6, 1992. Section VI: This Resolution shall be effective upon its adoption.
