A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ORANGE UPHOLDING THE RECOMMENDATION OF THE
ZONING ADMINISTRATOR OF THE CITY OF ORANGE AND
APPROVING A CONDITIONAL USE PERMIT TO ALLOW
THE RENOVATION AND CONVERSION OF AN EXISTING
SERVICE STATION TO BE USED AS A MINI-
MARKET AND TO ALLOW THE SALE OF BEER AND WINE
IN CONJUNCTION WITH THE SALE OF MOTOR FUEL
UPON PROPERTY SITUATED AT THE NORTHWEST CORNER
OF KATELLA AVENUE AND CAMBRIDGE STREET (825

TEM BEYER RECITALS:After a hearing thereon by the Zoning
Administrator and after due public hearings as required by law, and
after receiving a decision from the Zoning Administrator,
recommending that Condi-tional Use Permit 1850-90 be granted to
allow the renovation and conversion of an existing service station to be
used as a mini-market and to allow the off-sale transfer
of beer and wine in conjunction with the sale of
motor fuel upon existing property situated at the northwest corner
of Katella Avenue and Cambridge street (825 East Katella
Avenue), the City Council considered Conditional Use Permit 1850-
90 and determined that the recom-mendation of the
Zoning Administrator should be upheld and Conditional Use Permit
1850-90 be approved. Subject property is more particularly
described as the northwest corner of Katella Avenue and Cambridge
street with approximately 150 feet of frontage on
Katella and 155 feet along Cambridge street.During the
public hearing, the City Council heard testimony from the applicant as well as
the Public, one of whom spoke in favor of,
the other in opposition of the proposal.NOW, THEREFORE, BE IT RESOLVED
by the City Council of the City of Orange that Conditional
Use Permit
1850-90 be approved for the following reasons:1. That
the proposal conforms to sound principles of land use and is
in response to services required by the community.2.
That approval of this proposal will not cause deterioration of
bordering land uses or create special problems
for the area in which it is located.3. That the
proposal is
consistent with the City'S adopted general plan.4. That
conditions will be
BE IT FURTHER RESOLVED, that the following conditions are
imposed with approval of this Conditional Use Permit.
1. Development shall be substantial compliance with the plans
approved by the Zoning Administrator and on file with the
Department of Community Development.
2. Prior to the submittal of building permits, the city's
Design Review Board shall review and approve preliminary and
final building, landscape and irrigation plans.
Prior to issuance of the building permits, all proposed site
plan improvements must be completed.
3. The walkway accessing the building shall be extended to
comply with handicap standards.
4. The parking arrangement shall be redesigned to accommodate
all parking in a central area. The parallel parking space
located along the west property line shall be relocated to the
proposed parking area along the north property line.
5. No beer or wine shall be displayed within five feet of the
cash register or the front door.
6. No advertisement of alcoholic beverages shall be displayed
at motor fuel islands.
7. No advertisement of alcoholic beverages shall be made from
a drive-in
window.8. No display or sale of beer and wine shall be made from
an ice
tub.9. No beer or wine advertising shall be located on motor
fuel islands and no advertising for beer and wine shall be
visible outside the
building.10. Employees on duty shall be at least 21 years of age
to sell beer and
wine.11. All structures shall comply with the requirements
of Municipal Code Chapter 15.52 (Building Security
Standards),which relates to hardware, doors, window, lighting,
etc...Ord. 7-79). Approved structural drawings
shall include sections of the security code that
apply. Specifications,details, or security notes may be used to
convey the compliance. This will be reviewed in a plan check
by the Crime Prevention Bureau prior
to approval.12. Alcoholic Beverages shall be secured and shall
not be accessible from 1:00 a.m. until 6:00 a.m.,
and refrigeration doors to coolers where alcoholic beverages are
displayed for sale shall
be locked.13. Plans and permits for tank removal and
installation must be submitted and obtained from the City's
Building Depart-ment. Such removal and installation shall comply
with State RESO No.
and Local requirements of the Hazardous Material Subdivision
of the Fire Department.
14. Ingress and egress on Katella Avenue and Cambridge Street
shall be restricted to "Right Turn Only" as required by the
City's Traffic Division, Department of Public Works.
15. No alcoholic beverage shall be sold after 1:00 a.m.
16. No wine or distilled spirits shall be sold in containers
less than 750 mI. No wine shall be sold with an alcoholic
content greater than 15 percent by volume
17. No pool tables or coin operated amusement devices shall be
maintained in the licensed premise.
18. No alcoholic beverages shall be consumed on any property
adjacent to the licensed premises under the control of the
licensee.
19. No malt beverage products shall be sold in less than six
pack quantities for sale.
20. Signage shall be posted prominently advising all patrons
to exit with due regard for the neighborhood, advising that
on-site consumption is prohibited, prohibiting
loitering,advising that Thrifty will cooperate with law enforcement
with regard to any violations on the premises. Thrifty shall
post signage regarding the age limit for the purchase of
alcoholic beverages and advising against drinking and
driving.21. Thrifty shall preclude attraction of minors and others
by precluding public telephones and precluding the maintenance
of any large candy counter at the entry to the
premises.22. Appropriate security illumination shall be
installed
on-site.23. Reasonable buffering shall be utilized to
mitigate any impact on adjacent areas of
the community.24. If not utilized, Conditional Use Permit
1850-90 shall expire 24 months from the
date of approval.ADOPTED this 28th day
