A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ORANGE ON SUPPORTING STATE LEGISLATION
ENDING THE PRACTICE OF IMPOSING UNFUNDED
STATE MANDATES ON MUNICIPAL GOVERNMENTS AND
TO ENSURE THAT THE STATE GOVERNMENT PAYS
THE COSTS INCURRED BY MUNICIPALITIES
IN COMPLYING WITH CERTAIN REQUIREMENTS
UNDER STATE STATUTES AND REGULATIONS.
WHEREAS, unfunded state mandates on municipal
governments have become increasingly extensive in recent years;
and
WHEREAS, such mandates have, in many instances, added
to growing deficits in municipal budgets and have resulted in the
need for municipal governments to increase revenue or curtail
services; and
WHEREAS, such excessive fiscal burdens on municipal
governments have in many instances, undermined the ability of
municipal governments to achieve their responsibilities under
state and local law; and
WHEREAS, the City recognizes that not all state
mandated programs cause a financial burden on municipal govern-
ments. However, the City of orange is concerned with the current
practice by the state of California, and its agencies, of
enacting mandates that clearly place a financial hardship on
municipal governments which have significant impact on municipal
government budgets. The City of orange believes that the state
Legislature needs to address the issue in such a way as to ensure
that state funding is provided to municipal governments in those
cases where projected cost of mandated programs can be shown to
place a financial burden on municipal governments; and
WHEREAS, further, the city of Orange believes that when
studying the issue of state mandated programs that cumulative
impacts of multiple mandates emanating from the state Legislature
and various state agencies needs to be considered when attempting
to address the financial impact on municipal governments. Such
unfunded state mandates are a direct threat to the ability of
municipal governments to decide priorities.
NOW, THEREFORE, the City Council of the City of Orange
resolves as follows:
SECTION 1: To support state legislation which would
end the practice of imposing unfunded mandates on municipal
governments which cause an undue financial burden and ensure that
the State of California provides funds for those mandated
programs that impose financial hardship on municipal governments.
SECTION 2: To direct the city Clerk to forward a copy
of this resolution to the Governor of the state of california, to
all members of the state Legislature who represent the City of
Orange, and to the state, and county divisions of the League of
cities.
