RESOLUTION NO. 8227
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE AMENDING RESOLUTION NO.
5620 PERTAINING TO THE ADMINISTRATION,
INVESTIGATION, ALLOWANCE, COMPROMISE,
AND SETTLEMENT OF OCCURRENCES
INVOLVING CIVIL LIABILITY TO THE CITY.
WHEREAS, in Resolution No. 5620, the City Council, pursuant to Government Code
Section 935.4, delegated authority to the City Manager and the City Attorney to settle certain
liability claims if the amount of such settlement does not exceed $5,000.00; and
WHEREAS, Resolution No. 5620 further provides that the Claims Settlement
Committee is authorized by the City Council to settle certain liability claims if the settlement
exceeds $5,000.00 but is less than $20,000.00; and
WHEREAS, the city's Risk Manager has assumed greater responsibility in investigation
and settlement of property damage claims against the city; and
WHEREAS, the City Council finds that it would be more efficient and cost effective in
the administration and resolution of such claims to delegate to the city's Risk Manager
authority to investigate, compromise, and settle such property damage claims if the amount of
such settlement does not exceed $2,000.00.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange as
follows:
Section I:
Resolution No. 5620 is hereby amended by adding NO.7 to Page 2 thereof to read as
follows:
7. The Risk Manager is authorized to allow, compromise, or settle all property damage
claims for which the City of Orange is not insured by an insurance carrier if the amount to be
paid by the city pursuant to such allowance, compromise, or settlement does not exceed
2,000.00."
Section II:
In all other respects, the provisions of Resolution No. 5720 shall remain in full force and
effect.
