A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ORANGE ESTABLISHING A CITY-WIDE
VOLUNTEER PROGRAM AND PROVIDING WORKERS' COMPENSATION
FOR CERTAIN VOLUNTEERS PURSUANT TO THE PROVISIONS
OF LABOR CODE SECTION 3363.
5 WHEREAS, the City of Orange desires to establish a city-wide Volunteer
Program; and WHEREAS, the program would provide city departments with
additional manpower through qualified volunteers to assist in various special programs and areas in a
restricted and controlled
environment; and WHEREAS, the volunteers will be given a clear assignment and a clear
understanding of their duties and
responsibilities; and WHEREAS, the city will provide workers' compensation coverage to the
volunteers if injured during the course of their volunteer
service; and WHEREAS, by providing workers' compensation coverage not only ensure
the volunteer receives appropriate medical treatment, but also protects the city against
costly litigation.NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange
that the city-wide Volunteer Program be established and workers compensation
coverage be provided to the volunteers during the course of their service
to the city.BE IT FURTHER RESOLVED that the participants in the volunteer
program shall be administered under
the following provisions:1. The program shall be coordinated through the Personnel
Department for proper processing and
delegation of resources;2. The volunteers will serve gratuitously and shall not receive
salary, wages, or compensation for such volunteer services rendered and shall not be deemed
as employees of the City of Orange
for any purpose;3. All volunteers shall be placed in a controlled environment and not
be deemed as replacements of any employee
4. Volunteers must meet the requirements established by the hiring departments with the
approval of the Personnel Department to participate in the program. A volunteer may be
terminated at any time with or without cause, and any participant may resign as such at any
time by providing written notification.
