A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE UPHOLDING THE RECOMMENDA-
TION OF THE PLANNING COMMISSION OF THE
CITY OF ORANGE AND APPROVING THE RECLASSI-
FICATION OF PROPERTY SITUATED ON THE SOUTH-
WEST CORNER OF SANTIAGO CANYON ROAD AND
ORANGE PARK BOULEVARD,
PRE-ZONE CHANGE

ORANGE RECITALS:After due public hearings as required by law, the
city council of the City of orange considered a recommendation of
the Planning commission of the city of Orange recommending, by Resolution
No. PC 19-93, that certain property situated on the
southwest corner of santiago Canyon Road and Orange Park Boulevard
be reclassified from the county E4 District to the R-1-
40 District, and approved said recommendation after
finding and determining the hereinafter described facts, The real property which
is the subject of the reclassification is more
particularly described in
Exhibit "A"which is attached,Upon the public hearing before
the city council,
the following facts were established.1, The project area consists
of 22 contiguous properties located westerly of orange Park
Boulevard and southerly of Santiago Canyon Road. The area is part of
orange Park Acres and is developed with single family residences
on acre sized lots and the
Salem Lutheran Church and School,The total project area is 29.

2. Proposed pre-zone change for 22 unincorporated parcels
under County of Orange jurisdiction to the city of Orange
zoning district of R-1-40 (Single Family
Residential, minimum lot size one acre), The pre-zone change
request is
for City annexation purposes,Orange Municipal Code Section 17,
06.010 allows pre-zoning,subject to Planning Commission
and city Council approval, and sets forth the
following procedure for zoning and classification
of land outside the City:A, All territory outside the City
but within the City'S sphere of influence may
be pre-zoned prior to annexation to the city in
accordance with the procedures outlined in Section 17.06.050 et, seq,
and Chapter 17,92 and as provided for in section
65859 of the Government
Code of the State of California.B, When territory outside
the City has been classified for land use, then
such territory so annexed and classified for zoning shall become a part
of the City's Zoning Map and thereafter be subject
to the provisions of this Code.3, These properties are all part
of Annexation No. 396 to the city of Orange, On
February 16, 1993 this annexation was recorded at the County and the
City is in the process of
renumbering the addresses for the structures,Services will commence
during the next few months, These properties are part of the Orange
Park Acre Plan area and have a one acre
E-4 County of Orange Estate zoning.4. The city's General
Plan Land Use Map designates the properties Estate Low Density
Residential, 0 to 2 dwelling units per acre". In
addition, the properties are located within the Orange Park Acres Plan (OPA)
area. The O.P,A, Plan was adopted in 1973 as an amendment
to the Land Use Element of the General Plan, The
O.P.A. Plan designates the subject properties as
Low Density Residential, 1-2 dwelling
units per acre and public/quasi public (church).5, The
subject area varies in topography. However, the majority of the
area is contained in a hillside setting, and is sloping.
Three of the 22 properties are undevelopedwiththeremainingpropertiesdevelopedwith
single family residences, one church and one school.6. Access to the
project area is via Santiago Canyon Road and Orange ParkBoulevard. Santiago Canyon Road is in the process of being widened by both
the County and City
perpendicular to santiago canyon Road and Chapman Avenue,

pre-zone change of 22 properties to the City of
Orange zoning district of R-1-40 Single Family
Residential, minimum lot size one acre), The properties
are currently under County of Orange zoning district (E-4 - One
Acre) which
requires the same minimum lot size standard,9, The proposed R-
1-40 zoning conforms with the city's General Plan Land
Use designation for the area of Estate Low Density Residential, as
well as conforms with the O,P.A, Plant
designation
of Low Density Residential (one acre minimum lot size),10,
The development standards and permitted uses of the existing County zoning
are very similar to that of the proposed City zoning. The
County E-4 - one acre zoning requires a minimum lot size of one
acre with no minimum lot width, The City R-1-40 zoning also
requires a minimum lot size of one acre and a minimum
lot frontage of 100 feet and depth of 100
feet.However, special considerations are granted to knuckle or cul-
de-
sac lots which do not meet frontage and depth minimum requirements.11.
only one of the lots contains less than the required minimum
lot size of one acre and will be
considered legally non-conforming, Any new construction or remodel would
be permitted as long as the
improvements conform to the R-1-40 development standards other than lot
size.12, There are three undeveloped parcels but all have in excess
of one acre in area, One is located
on a steep slope with limited access (AP 379-
481-01). The second vacant parcel 10502 Woodview circle) is owned
and adjoins the neighboring parcel at 19911
Hilton Lane. The third vacant parcel is owned and adjacent to
the Salem Lutheran Church,13, The Salem Lutheran Church and
School are
located on three separate parcels but share parking and access
and operate as one entity,Under the City R-
1-40 zoning, churches and schools will be allowed subject
to approval of a
approved by the County Zoning Administrator in May of 1988 for
the expansion of the existing Salem Lutheran Church and
school, This permit was an amendment to County Use Permit 82-
37 which allowed the increased capacity of the school from 220
to 395 school/pre-school
students.14, Orange Park Boulevard and Santiago Canyon Road are the
only City owned and maintained roads in the annexation area,
All other streets are privately owned by the individual
property owners, If the owners would like to have these
streets dedicated to the City, Public works would then have to
be notified and a field tour arranged for a survey ofexistingconditionsandthestatusof
dedication,15, This annexation has eliminated a large portion of a "
County Island" while consolidating jurisdictional responsibilities
to the City. The zoning will then become effective
immediately upon approval by the
City,HOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Orange that the recommendation of the Planning Commission
be upheld and that Pre-Zone 1157-93 reclassifyingthesubjectpropertytotheR-1-40 District be
approved for the following reasons:1, Approval of this Pre-
Zone Change request would allow the 22 properties to be annexed to
the City
and be provided with municipal services,2, The annexation would
eliminate part of a "County Island",and
consolidate jurisdictional responsibilities to the city,3. The existing
single family residential and church with school uses are consistent with
the permitted
uses of the City R-1-40
zoning,
