IRG)WBBRBAS, the City Council has authority under state law
and the Orange Municipal Code to approve a request for a
Tentative Tract Map;
and WBBRBAS, the project's environmental impacts have
been addressed by Addendum Environmental Impact Report 1143, which
was previously certified by the City Council in conjunction
with approval of a Development Agreement, General Plan Amendment
1-92 and Zone Change
1152-92; and WBBRBAS, the Planning commission did
recommend approval of the proposed Map after holding one duly
advertised hearing on February 17, 1993 for the purpose of
considering Tentative Tract No. 14752 upon property
described as follows:Lots 9 through 30 inclusive and
Lot A of Tract No. 9006, and portions of Lot
10 of the A.B. Chapman Tract, and the
north half and the north 6 feet of the south half
of Lot 9 block D of the A.

Chapman Tract.;and WHEREAS, the City Council did hold
one duly advertised public hearing, as required by law, on
March 16, 1993.ROW, THEREPORE, BE :IT RESOLVED that
the City Council approves Tentative Tract Map No. 14752 and
Conditional Use Permit 2006-93
for the following reasons:1. The proposed development is in conformance
with the city's development ordinances and the "
Development Agreement by and between the City of Orange
and Santiago Creek Associates".2. The proposed tentative tract map
will allow the orderly development
of the subject site.3. The proposed tentative tract map
and conditional use permit are SUbject to conditions to
assure public safety and utility
BB IT FURTHBR RESOLVED that the approval contained herein is
subject to the following conditions:
1. The final tract map shall be in substantial compliance with
plans as approved by the Planning commission and on file
with the Department of Community Development.
2. Developer shall be financially responsible for the
construction of all onsite facilities including in-tract
and channel improvements along Santiago Creek, and any
off-site improvements which may be required as part
of detailed engineering studies as specified in
the Development Agreement and Planned
Community text.3. Prior to issuance of grading and building
permits, the Design Review Board, Fire Department, and
Crime Prevention Bureau shall review and approve all public
trail entrances,utility/maintenance road entrances, and
emergency access road entrances which shall be treated with
landscaping and vehicle gates or approved security devices
which will restrict unauthorized vehicles from entering
the roadway,open space areas, or trail systems. Included in
that review is entry design and placement of barriers,
fencing, and landscaping. Approved vehicular gates shall
be equipped with a Knox Box for
emergency access.4. All single family attached homes shall have

Up garage doors.5. To assure compliance with the City's
requirements on the maximum amount of noise permitted within
a structure, a complete building interior noise
mitigation analysis is required for structures located on
parcels abutting Tustin street or parcels where only open space
areas are situated between the lot and Tustin street (Lots 15, 16,
and 47 as indicated on the Tentative Tract Map
reviewed by the Planning Commission on
February 17, 1993.)6. Prior to issuance of building permits,
the Design Review Board shall review and approve all
building, wall, signing,and landscaping plans. Also, the Design
Review Board and the Crime Prevention Bureau shall review
and approve fencing plans to assure conformance
with the following:A. All fencing required to be of
solid construction shall achieve a minimum height of 6
feet above finished grade, and be of
a non-climbable design.B. All fencing not required to
be of solid construction,such as a yard perimeter fence,
or a security barrier,shall be of a see through design.
It shall have a minimum height of 6 feet above
finished grade, and be of
a non climbable design.C. All combination fencing, such as
block wall and wrought iron, shall be of a non
climbable design as approached
from the exterior side of the fence when it is built as
a residential perimeter yard fence.
7. Prior to the recordation of the First Final tract map, city
shall form a landscape maintenance district which shall
include the Project for the purpose of levying and
collecting an assessment to maintain the Open Space Area as
defined in Exhibit E-1 of the Development Agreement for
the project. Said assessment shall not exceed the sum of $28.
00 per month per residential unit in the Project but may
be increased annually in accordance with the
applicable increased maintenance cost index as provided in
the Engineering News Record or such other comparable index
as the parties shall agree. This condition satisfies any
and all of Property Owner's obligations under the
Development Agreement for the Project pertaining to maintenance of
said Open Space
Area.8. The Tentative Tract Map shall be revised to add a one
acre parcel to the located north of the creek channel and
south of Rosewood Avenue at the west end of the subject
property.The one acre parcel shall have minimum dimensions of 200'
by 200' and this parcel shall be graded to a level
pad.Furthermore, this parcel shall be designated as numbered
Lot
48.9. An access easement for maintenance purposes only shall
be provided from Tustin Street to proposed Lot #48 and
such easement shall utilize the creek maintenance road or
service roads associated with a landscape maintenance
district.10. Dedicate to the City of Orange ingress and egress
easement over private streets and driveways for trash
collection,emergency services, and other city related
functions.11.* Provide a left turn pocket on Tustin Street for left
turn access into the
site.12.* Limit height of landscape plantings and signs within
the vicinity of project driveways to assure good
visibility.13.* Modify the existing traffic signal at Tustin Street/La
Veta Avenue to accommodate the west leg of the
intersection project
entrance).14.* Restrict project driveways to Tustin Street, north and
south of the project entrance to right turns
only.15.* Construct Tustin Street bordering the project to
ultimate half-section width in conjunction with
development (the construction shall include only that portion
of street widening south of the Tustin Street bridge,
and such construction shall not include any portion of
the bridge).16.* The project shall participate in fair share
funding as required for improvements for
the Tustin-Chapman intersection for existing plus
project cumulative traffic 3
conditions. The Traffic Engineering Division shall estimate
and collect the required fees for the project.
17.* The project shall provide a transit stop with a bus turnout
on Tustin street (southbound) at the project entrance and
include a passenger waiting area with shelter and bench and
pedestrian access to the stop from the project which
accommodates the handicapped. All design and construction
shall conform to Orange County Transit District standards
and meet the approval of the city Engineering Department.
18.* A final map shall not be approved, nor shall any permits be
issued for project grading or development prior to approval
of the Santiago Creek channel design by all permitting
agencies. Final design of the proposed channel will be
approved by written agreement from all applicable agencies
including~ but not limited to the City of orange Public
Works Department, the Orange County Flood Control District,
the Army Corps of Engineers, and the Federal Emergency
Management Agency, prior to issuance of building permits.
Channel design shall ensure proper conveyance of upstream
and project flows and be designed to accommodate appropriate
storm flows. Construction compliance shall be verified by
the project engineer and the City of Orange Public Works
Department.
19. All off-site easements shall be required by the city
subject to the provisions of the Development
Agreement.20.* The project applicant shall submit a final drainage plan
to the Public Works Department for review and approval prior
to issuance of grading permits as required by the City
of Orange. The drainage plan shall be designed to
incorporate flows conveyed to the channel by the city maintained
60-inch
SAVI line.21.* Prior to the issuance of grading permits,
the applicant shall provide the City of Orange Planning
Department with evidence of approval of a CDFG 1603 Agreement
and USCOE section 404 Permit (including
implementation requirements for an onsite riparian
mitigation plan).22.* The onsite greenway containing an open creek
drainage and recreational trail shall incorporate design
measures to ensure emergency access and
crime prevention.Conditions 23 through 32 shall be complied with
to the satisfaction of the City of Orange's Crime
Prevention Bureau:23. All structures shall comply with the
requirements of Municipal Code - Chapter 15.52 (Building Security
Standards,Ord. 7-79), which relates to hardware,
doors, windows,lighting, etc. Approved structural drawings
shall include sections of the security code that
apply. specifications,details, or security notes may be used to
convey the compliance. This will be reviewed in a plan check
by the Crime Prevention Bureau prior
to
approval.4 Reso
24. Provide crime Prevention Bureau with lighting photometrics
for required parking/access areas. This shows compliance
with the minimum maintained (1) foot-candle. Point
to point, or contour analysis is accepted along with the
data sheets, showing the luminaries, model/wattage/
height.25. Provide crime Prevention Bureau with lighting
photometrics for required walkway areas. This shows compliance with
the minimum maintained .25 foot-candle. Point to
point, or contour analysis is accepted along with the
data sheets,showing the luminaire, model/wattage/
height. (including bike/
ped. trail)26. A second building/unit address of 4 inches in
height is required. Shall be illuminated/
non-illuminated, contrasting in color to the background and
visible to approaching vehicles at driveway entrance for Lots
2 and 4.27. Monument Address signs of 8 inches in
height are required.Shall be illuminated or contrasting in color
in a location not obstructed by landscaping or cars and
approved by Crime Prevention
Bureau and ORB.28. All landscape shall be maintained not
to interfere with
required illumination/addressing.29. Comply with requirements of rural
and
private street lighting.30. Comply with requirements for
mechanical parking gates relating to Knox over-ride
emergency key, contact Orange Fire Prevention
for appropriate application information.Also recreation area (
if pool/spa proposed).31. Public recreation and
circulation areas (riding/hiking trails) shall include motor vehicle
barriers at entrances to discourage illegal use. Trails
themselves shall be designed so that trespassing onto
neighboring lands is minimized,thus reducing the opportunities
for
theft, vandalism, and burglary.32. All handicapped suites shall be required
to have a second 180 degree door viewer, not to be
mounted more than forty four (44) inches from the bottom of
the door (Lot 47).Conditions 33 through 40 shall be
complied with to the satisfaction of the City
of Orange Water Department:33. That an on-site dedicated
water system be installed as designed by the
City of Orange Water Department.34. That a fifteen-foot
easement be dedicated to include the water main,
meters, detector checks, and fire hydrants.35. That each
building be metered separately unless
otherwise approved by the
36. That the developer shall satisfy all water main connection
charges as determined by the Water Department.
37. That a minimum 80' X 60' graded well site with an ingress,
an egress, and utility easement be dedicated to the city of
Orange prior to the final map approval as set forth in the
Development Agreement. The well site shall be located such
that a well can be constructed a minimum of fifty feet from
the nearest sewer line. The location of the well site shall
be mutually agreed upon by the City and the Developer.
provisions for utility service shall be provided to the
property line, including a 3 phase 480 volt electrical
service, and 4" electrical and 2" telephone conduits. A
drain line with a minimum capacity of 8 C.F.S. shall be
constructed from the well site to a storm drain.
38. That the proposed bridge across the Santiago Creek be
constructed to provide for the installation of a waterline
to be hung or built through the bridge.
39. That a waterline be constructed from the well site to the
distribution line in the proposed tract.
40. That a drain line be constructed from the well site to a
storm drain with the capacity of handling 8 C.F.S.
Conditions 41 through 57 shall be complied with to the
satisfaction of the city of Orange Fire Department:
41. All R1 or R3 occupancies 5000 square feet or greater shall
be provided with an approved fire sprinkler system. The
fire sprinkler system must be installed per O.M.C. 15.32.080
section 10/306 (a). The system shall be designed per
N.F.P.A. 13D or 13R, U.B.C. chapter 38 and U.B.C. standard

1.42. The Fire Department connection shall not be affixed to
the building. The Fire Department connection must be located
at least 40 feet away from the building, within 40 feet of
a fire hydrant and on the address side of the building,
unless otherwise determined by the Fire
Department.43. Provide on-site fire hydrant(s) and mains
capable of supplying the required fire flow. The hydrant model
and on-site locations shall be approved by the Fire
and Water Departments and have a three foot minimum
clearance around the circumference of the
fire hydrant.44. The number of required hydrants will be determined
by the Fire and
Water Departments.45. Every building shall be accessible to the
Fire Department apparatus by an access roadway of not less than 20
feet of unobstructed width having a minimum of 13 feet 6
inches of vertical clearance. The access roadway shall be
extended to Reso No.
within 150 feet of all portions of the exterior walls of the
first story of any building. U.F.C. section 10.207
46. Dead-end Fire Department access roads in excess of 150
feet long shall be provided with approved provisions for
the turning radius of Fire Department apparatus. U.F.C. 10.
207 An approved Fire Department turn around shall be
provided at the northeast end of the
site.).47. Dead-end Fire Department access roads shall not
exceed 600 feet
in length.48. Provide a secondary emergency access that is
built and maintained in accordance with U.F.C. 10.207 O.
M.C.15.
32.110.49. The Fire Department access roadway shall be an
all weather driving surface capable of supporting the imposed
loads of fire apparatus, 40,000 pounds. U.F.C.
10.201 50. The proposed bridge over Santiago Creek
shall accommodate
fire apparatus.51. Approved Fire Department access shall be provided
for the bike trail. provisions shall be made for
Fire Department access or turn around at the west end of the
bike trail.52. The Fire Department access roadway shall be
provided with adequate turning radius for Fire Department
apparatus. (A40 foot outside and 20 foot inside radius.) U.F.C.
10.207 53. Fire Department emergency access must not exceed

percent grade.54. The total width must be continuously paved
to accommodate 40,000 pounds and shall not exceed the angle
of departure for fire apparatus on
any slope.55. Fire access lanes are to be posted and
red curbed.Identification of fire lanes must meet City of
Orange Fire
Department Standards.56. All mechanical gates shall be provided with
a key-operated override per City of
Orange Ordinance 9-84.57. Fire Facilities Fees shall be
paid
per the Development Agreement.Conditions 58 through 91 shall be
complied with to the satisfaction
of the City Engineer:58. The onsite channel improvements to
Santiago Creek shall be completed in conjunction with
the first phase of construction within the residential
development
area of the project.
59. Subject to specific reclamations and procedures for
rehabilitating Tract 9006 (Rosewood Tract) being submitted
for review and approval prior to any grading plan approval
and issuance of grading permits.
60. A sidewalk shall be constructed on Tustin Street across
proposed Lot '47.
61. The Tentative Tract Map shall be revised to delete any
reference that the storm drains shall be dedicated to the
city, and that all on-site storm drain systems shall
be maintained by the property
owner.62. Subject to conditions of Addendum Sheet No.
1.63. A final tract map shall be recorded within 24 months
after tentative approval and prior to the sale or lease of
any parcel proposed by TTM 14752. This condition shall
not preclude the sale or lease of the entire residential
or senior citizen component of the
project.64. Monuments shall be set based on a field
survey.65. Dedicate and construct Tustin Street to City
standards,including required bus bay
turnout.66. Private street(s) shall be constructed to City's
private street
standards.67. Final design of gated vehicular entry shall be reviewed
and approved by the Traffic
Engineer.68. Grading, landscape and wall plans shall be designed
to provide proper sight distance at all street
intersections.69. Construct storm drain(s) to city standards. Storm
drain system to a private system, owned and maintained by
the homeowners
association.70. C,C & R's shall be reviewed and approved by City
Attorney prior to approval of final
map.71. That 4" electrical and 2" telephone conduits be installed
to the well
site.72. subject to paying the major thoroughfare and
bridge transportation system improvement program,
police facilities, fire facilities, and school development
fees prior to issuance of building permits in accordance
with Development
Agreement.73. Temporary desilting facilities shall be installed
to adequately prevent storm water erosion in graded areas
of
tract.74. Subject to submitting developers "Best Management
Practices"for pollution control based on National Pollution
Discharge Reso No. 8164
Elimination Systems (NPDES) requirements prior to issuance
of grading permits.
75. C~le television facilities shall be installed as required
by city franchise cable television company.
76. Construct turn-a-round curb and gutter at east
end of existing Rosewood Avenue and proposed
emergency access.Turn-a-round radius to be within
existing
curb to curb dimensions.77. Submit sewer study for review and approval
prior to any plan approval. Off-
site sewer may be
required.78.Provide
stub outlet future storm

at west end of tract boundary at drop structure

improvements as required by the Development Agreement.81. Capacity of the low
flow channel within the creek shall be determined by EMA and
City of Orange in accordance with the terms of
the Development Agreement. Said channel shall
be dedicated to EMA for maintenance purposes.82. Bike trail and
channel access roads shall be extended to Cambridge Street
westerly of the project site in accordance to the
provisions of the Development Agreement. The City shall provide
easements to provide for bike trail and channel access roads
from the
site's westerly boundary to Cambridge Street.83. Lettered Lots "0"
through "s" shall be maintained by
a Homeowners Association. Maintenance requirements shall be detailed
in tract's C, C, & R's.84. All streets
and drives shall be
constructed to provide proper vehicular site distance.85. The
developer shall provide precise horizontal and vertical roadway alignment
for the proposed main entry roadway and existing La Veta Avenue.
The final plan shall be subject to review and approval by
the
city's Traffic Engineer and City Engineer.86. The Tentative Tract
Map shall be redesigned to provide all
elements and requirements contained in Planned Community text (Section 6.1),
and
to the city's

Developer shall
construct a far-side busbay on Tustin street south of
the main entry roadway per city of orange Standard Plan No.
129.88. Prior
to final tract approval, the developer shall provide a city approved
precise horizontal and vertical roadway alignment for
the proposed main entry roadway and existing La Veta
Avenue. This plan shall cover a minimum distance of 400 feet
on each side of Tustin Street and shall show a proposed striping
plan. The above shall be approved by the city Engineer
and the City Traffic Engineer.89. Pedestrian
facilities shall be provided on both sides of the main entry
roadway between the gate entry and Tustin street.90. Developer
shall provide a signing, striping, and street lighting plan
for the main entry roadway between Tustin Street and
the gate entry.91. Curb
returns at the main entry roadway and Tustin Street shall have
a 32 foot radius.ADOPTED this
