RES-ORA-0266 Approving the Use of Low- and Moderate-Income Housing FundsRESOLUTION NO. ORA- 0266 A RESOLUTION OF THE ORANGE REDEVELOPMENT AGENCY APPROVING THE USE OF LOW- AND MODERATE-INCOME HOUSING FUNDS AND APPROPRIATING FUNDS FOR THE CODE ENFORCEMENT GRANT PROGRAM - NOT TO EXCEED $50,000 FROM TUSTIN EXCESS INCREMENT FUND/CODE ENFORCEMENT GRANT PROGRAM WHEREAS, the City of Orange (the "City") has prepared and adopted Redevelopment Plans (the "Redevelopment Plans") for the Tustin Street Redevelopment Project, the Northwest Redevelopment Project, and the Southwest Redevelopment Project; and WHEREAS, each of the Redevelopment Plans provides for the use of tax allocation financing from the Project Areas of the respective Projects; and WHEREAS, Section 33334.2 of the California Community Redevelopment Law Health and Safety Code Section 3300, et seq.) requires that not less than twenty percent 20%) of all taxes so allocated be used for the purpose of improving, increasing, and preserving community's supply of low- and moderate-income housing available at affordable housing cost; and WHEREAS, Section 33334.2(g) of the Health and Safety Code provides that such funds may be used outside a project area if a finding is made by resolution of the Agency and the City Council that such use will be of benefit to the project; and WHEREAS, the Agency is authorized to improve land or building sites with on- site or off-site improvements pursuant to Section 33334.2(e) (2) and to rehabilitate buildings or structures pursuant to section 33334.2(e) (6) of the California Health and Safety Code; and WHEREAS, the Agency has created and implemented a Code Enforcement Grant Program (the "Program") on a city-wide basis to help owner-occupants with their code- related violations for home repair; and WHEREAS, pursuant to the Program, certain assistance may be available for the benefit of certain households who meet eligibility requirements, including that household income be no greater than 100% of median income.NOW, THEREFORE, BE IT RESOLVED by the Orange Redevelopment Agency as follows:Section 1. The Orange Redevelopment Agency approves the Program as follows: (i) a maximum $5,000 grant be offered to qualified residents who have received Notices of Violation by a Code Enforcement Officer for homes that need and Safety Codes and/or City standards on the terms and conditions as set forth in the Program guidelines; (ii) the grant monies would be made available to upgrade the exteriors of residential units (painting, doors, screens, roofs) and be limited to the interior upgrading of electrical and plumbing to meet Health and Safety Codes only; and (iii) this Program is to be administered by the Agency Office based upon appropriate notice and/or citations from Code Enforcement. All Program participants must agree to non-discrimination in the provision of improvements and in the use of the premises.Section 2. The Agency finds and determines that the expenditure of monies from the Low-and Moderate-Income Housing Fund for each of the project areas is benefit to each of those project areas.The Agency acknowledges that the Agency has authorized the Agency Executive Director, the Finance Director, and staff to expend or cause to be expended Housing Funds from each of the Project Areas, including, but without limitation, the proceeds of tax allocation bonds and ratifies such approval.Section 3. The Agency consents to appropriate $50,000 from the Tustin Excess Increment Fund for the continuation of the Program.Section 4. The Agency authorizes and directs staff to proceed with the provision of continuing the Program.ADOPTED this ~ day of 1993.
