RES-8157 Approving the Use of Low- and Moderate-Income Housing FundsRESOLUTION NO. 8157 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE APPROVING THE USE OF LOW- AND MODERATE- INCOME HOUSING FUNDS AND AUTHORIZING APPROPRIATION OF FUNDS BY THE ORANGE REDEVELOPMENT AGENCY FOR THE CODE ENFORCEMENT GRANT PROGRAM - NOT TO EXCEED 50, 000 FROM TUSTIN EXCESS INCREMENT FUNDI CODE ENFORCEMENT GRANT PROGRAM WHEREAS, the City of Orange (the "City") has prepared and adopted Redevelopment Plans ( the "Redevelopment Plans") for the Tustin Street Redevelopment Project, the Northwest Redevelopment Project, and the Southwest Redevelopment Project; and WHEREAS, each of the Redevelopment Plans provides for the use of tax allocation financing from the Project Areas of the respective Projects; and WHEREAS, Section 33334.2 of the Califomia Community Redevelopment Law Health and Safety Code Section 3300, et seq.) requires that not less than twenty percent 20%) of all taxes so allocated be used for the purpose of improving, increasing, and preserving community's supply of low- and moderate-income housing available at affordable housing cost; and WHEREAS, Section 33334.2(g) of the Health and Safety Code provides that such funds may be used outside a project area if a finding is made by resolution of the Agency and the City Council that such use will be of benefit to the project; and WHEREAS, the Agency is authorized to improve land or building sites with on-site or off-site improvements pursuant to Section 33334.2(e) (2) and to rehabilitate buildings or structures pursuant to section 33334.2(e) (6) of the California Health and Safety Code; and WHEREAS, the Agency has created and implemented a Code Enforcement Grant Program (the "Program") on a city-wide basis to help owner- occupants with their code-related violations for home repair; and WHEREAS, pursuant to the Program, certain assistance may be available for the benefit of certain households who meet eligibility requirements, including that household income be no greater than 100 % of median income.NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange as follows:Section 1.The City Council has reviewed Section 2. The City Council acknowledges that the Agency has authorized the City Manager, the Finance Director, and staff to expend or cause to be expended Housing Funds from each of the Project Areas, including, but without limitation, the proceeds of tax allocation bonds and ratifies such approval. Section 3. appropriate Program.
