A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ORANGE APPROVING THE APPROPRIATION AND
EXPENDITURE BY THE ORANGE REDEVELOPMENT
AGENCY OF CERTAIN FUNDS FOR DESIGNATED
PUBLIC IMPROVEMENTS TO THE CITY CORPORATION
YARD, AND MAKING CERTAIN FINDINGS IN
CONNECTION THEREWITH (INSTALLATION OF PUBLIC
BUILDINGS - NOT TO EXCEED $50,000.00 FROM NORTHWEST
PROJECT AREA FUNDS)WHEREAS,
by Ordinance No. 22-88 adopted on June 28, 1988, the City Council of
the City of Orange adopted and approved a certain Redevelopment Plan (the "Redevelopment
Plan") for the Northwest Redeyelopment Project (the "Project"); and
WHEREAS, pursuant to the Community Redevelopment Law of the State of California
Health & Safety Code Section 33000, et ~.), the Orange Redevelopment Agency (the
Agency") is carrying out the Redevelopment Plan for the Project in the Redevelopment
Project Area (the "Project Area"); and
WHEREAS, in furtherance of the Project, the City of Orange (the "City") will install
and construct, certain improvements to serve the Project (the "Improvements") as described in
Exhibit" A" attached to said agreement, and the Agency proposes to pay the City in connection
therewith an amount equal to the lesser of (i) the cost of the Improvements or (ii) Fifty
thousand dollars ($50,000.00); and
WHEREAS, the Redevelopment Plan for the Project provides for improvements to the
City Corporation Yard; and
WHEREAS, the Improvements are of benefit to the Project Area in that they will
enhance the area and contribute to the elimination of blight throughout the Project Area, and in
the immediate neighborhood in which the Project Area is located; and
WHEREAS, the hearing of this matter has been duly noticed and a summary of the
proposed activities, which describes the provision of the Improvements and the identities of the
amounts proposed to be expended by the Agency in connection therewith pursuant to this
Agreement, has been available for public inspection (the "Summary"); and
WHEREAS, as more fully set forth in the Summary and the staff report accompanying
this Resolution, no other reasonable means of financing such Improvements are available to the
community in that the cost of the improvements exceeds the financial ability of the City to
pay, no private sources of funding are available, and all State and Federal grant alternatives
have been exhausted.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange
as follows:
Section I: The City Council hereby determines that the Improvements are of benefit
to the Project Area and the immediate neighborhood in which the Project Area is located and
that no other reasonable means of financing such Improvements are available to the
community, and hereby approves and authorizes the expenditures by the Agency funds within
the limitations set forth above in an amount equal to the lesser of (i) the cost of the
Improvements or (ii) Fifty thousand dollars ($50,000.00). The determination that the
Improvements will benefit the Project Area is based upon the following: (i) provision of the
Improvements directly implements certain provisions of the Redevelopment Plan, which
provide for improvements to the City Corporation Yard; (ii) the provision of the
Improvements will enhance the appearance of certain property within the Project Area; and
iii) those other and additional reasons set forth in the Summary and the staff report
accompanying this Resolution. Those moneys which are available to be applied for the
Improvements are property tax revenues of the Project. In no event shall any moneys be
expended pursuant to this Resolution for normal maintenance or operations of buildings,
facilities, structures, or other improvements.
