RES-8415 Granting Conditional Use Permit No. 2075-94RESOLUTION NO. 8415 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE UPHOLDING THE RECOMMENDATION OF THE PLANNING COMMISSION OF THE CITY OF ORANGE AND GRANTING A CONDITIONAL USE PERMIT TO ALLOW EXPANSION OF A HOSPITAL UPON PROPERTY SITUATED AT 1100 WEST STEWART DRIVE. CONDITIONAL USE PERMIT 2075- 94 APPLICANT: ST. JOSEPH HOSPITAL RECITALS:After report thereon by the Planning Commission and after due public hearings as required by law, and after receiving a recommendation from the Planning Commission, recommending, by Resolution No. PC-32-94, that Conditional Use Permit 2075-94 be granted to allow expansion of a hospital upon property situated at 1100 West stewart Drive, the City Council considered Conditional Use Permit 2075- 74 and determined that the recommendation of the Planning Commission should be upheld and Conditional Use Permit 2075- 94 be granted. Subject property is more particularly described as follows:Parcel 3 in the city of Orange, County of Orange,State of California, as shown on map filed in Book 106, pages 9 and 10 of parcel maps in the office of the County Recorder of said County.During the public hearing, the City Council found the facts more particularly set forth as follows:1. The applicant, st. Joseph Hospital, is proposing a 20,200 sq. ft. building addition onto the southeast corner of the st.Joseph Hospital building and the remodeling of an existing parking lot. The proposed building addition will be used to consolidate the emergency services of both st. Joseph and CHOC Hospitals.2. The variance request is to waive the requirement to provide a 10 foot wide landscaped setback for the proposed ambulance drive aisle along Pepper street, while the administrative adjustment request is to allow a 10% reduction of the front setback area after La Veta Avenue is widened.3. The subject site is zoned PI (Public Institutional). The project is located on the north side of La Veta Avenue and east of Pepper Street. The surrounding area is developed with medical office and out patient services related to st. Joseph and CHOC Hospitals.4. The Planning Commission recommends that the City Council approve the project as emergency medical service is a necessary use needed by the community and that the reduction in street side setbacks is NOW, THEREFORE, BE IT RESOLVED by the City Council of the city of Orange that Conditional Use Permit 2075-94 be granted for the following reasons:1. The proposed use will provide services needed by the community.2. The project, subject to the conditions noted below, will not have an adverse impact on surrounding land uses.BE IT FURTHER RESOLVED by the city Council of the City of Orange that Conditional Use Permit 2075-94 be granted subject to the following conditions:1. The project shall be constructed per plans approved by the Planning Commission and on file with the Department of Community Development.2. Within 2 days of the final approval of this project, the applicant/developer shall deliver to the Planning Division a cashiers check payable to the County Clerk in an amount required to fulfill the fee requirements of Fish and Game Code section 7l1.4(d) (2) and the County administration fee,to enable the City to file the Notice of Determination required under Public Resources Code Section 21152 14 Cal.Code of Regulations 15075. If it is determined that there will be no impact to wildlife resources, the fee shall be 25.00. If the applicant/developer has not delivered the required fees within such two day period, the approval for the project granted herein shall be void.3. Prior to issuance of building permits, the applicant shall provide final building landscaping and irrigation plans to the Design Review Board.4. The property owner shall dedicate a minimum 10 foot strip of property along the entire La Veta frontage as required by the city's Department of Public Works.5. At initiation of construction, and during the construction activities, the applicant shall provide signing to direct visitors and employees to access and parking areas.6. At the time the La Veta Avenue street widening is completed,the parking lot shall be redesigned and landscaped as per approved plans on file with the Department of Community Development.
