RES-8394 Summarily Vacating and Abandoning a Portion of Loma Street Easement for Utility PurposesRESOLUTION NO. 8394 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE SUMMARILY VACATING AND ABANDONING A PORTION OF THE LOMA STREET EASEMENT FOR STREET AND UTILITY PURPOSES. WHEREAS, Pacific Ridge Partners is the owner of certain property underlying a City easement for street and public utility purposes and has requested the City to vacate and abandon such easement: and WHEREAS, the California streets and Highways Co~e ~rcvida6 that the City Council may summarily vacate a street and public utility easement under specified circumstances.NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange as follows:section I:This summary vacation and abandonment of an easement for street and public utility purposes is made in accordance with the Public streets, Highways and Service Easements Vacation Law,California Streets and Highways Code sections 8300 et seq.section II:The subject easement to be abandoned and vacated is more particularly described in the legal description and map attached hereto respectively as exhibits "A" and "B" and are incorporated herein by this reference.section III:The subject street and public utility easement is an excess right- of-way which is not required for street purposes.section IV:The subject street and public utility easement has never been used for the purposes for which it was dedicated and there are no current public utility facilities located within the subject easement.section V:Upon payment by property owner of City adminstrative fees,the City Clerk is directed to cause a certified copy of this resolution of vacation, attested by the Clerk under seal, to be recorded without acknowledgment, certificate of acknowledgment,or further proof in the office of the recorder of the County of seotion VI: That from and after the date of such recordation, the subject easement shall no longer constitute a street or public utilities easement.
