RES-8391 Granting Modification for Conditional Use Permit No. 1906-91RESOLUTION NO. 8391 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE UPHOLDING THE RECOMMENDATION OF THE PLANNING COMMISSION OF THE CITY OF ORANGE AND GRANTING MODIFICATIONS TO A CONDITIONAL USE PERMIT TO ALLOW CONSTRUCTION AND OPERATION OF A SELF STORAGE FACILITY AND CONSTRUCTION OF A TWO STORY BUILDING WITHIN 70 FEET OF PROPERTY ZONED R-1 UPON PROPERTY SITUATED NORTH OF CHAPMAN AVENUE AND WEST OF MCPHERSON ROAD PRIMARILY WITHIN THE FORMER SOUTHERN PACIFIC RAILROAD RIGHT-OF-WAY.MODIFICATION TO CONDITIONAL USE PERMIT NO. 1906- 91 JORDAN VALLI ARCHITECTS RECITALS:After report thereon by the Planning Commission and after due public hearings as required by law, and after receiving a recommendation from the Planning Commission recommending, by Resolution No. PC-22-94, that modifications to Conditional Use Permit No. 1906-91 be granted to allow construction and operation of a self storage facility and construction of a two story building within 70 feet of property zoned R-1, upon property situated north of Chapman Avenue and west of McPherson Road, primarily within the former Southern Pacific Railroad right- of-way, the City Council considered modifications to Conditional Use Permit No. 1906-91 and determined that the recommendation of the Planning Commission should be upheld and modifications to Conditional Use Permit No. 1906- 91 be granted. Subject property is more particularly described in Exhibit "A"attached. During the public hearing, the City Council found the facts as follows:1. That on August 27, 1991, the City Council approved Zone Change 1136-91 and Conditional Use Permit 1906-91 which allowed the subject site to be developed with a 72,000 square foot mini-storage facility with an apartment for an on- site manager. Public access to the facility would be from McPherson Road. The project site is located north 2. That the applicant is proposing to modify the approved site plan for the mini-storage facility by the following:adjusting the site's property boundaries,moving the projects' public entryway and manager' s unit,adding approximately 20,000 square feet of storage area, and changing a building from one to two stories.3. That the applicant is adjusting the project' s boundaries by a land swap with the owner of the office building to the east of the subject site and by buying an unused portion to the rear of the City's Resource Center site.4. That the applicant is requesting the revisions to his project to resolve several code problems caused by an adjacent office building that was built across his property line and to better utilize his property.5. That the Planning commission, by a vote of 4 to 1,approved the requested modifications to the proposal since the revised site plan improved on-site circulation and security, and the additional storage area and two story building would not have an adverse impact on surrounding residents and businesses. The one vote against the project reflected an opinion that the proposed mini-storage facility would create a barrier between various residential neighborhoods.NOW, THEREFORE, BE IT RESOLVED by the City Council of the city of Orange that modifications to Conditional Use Permit No. 1906-91 be granted for the following reasons:1. The revised site plan improves upon on-site circulation and the operation of a self-storage facility.2. The revised site plan does not adversely affect neighboring residents or businesses.BE IT FURTHER RESOLVED that modifications to Conditional Use Permit No. 1906-91 be granted subject to the following conditions:1. The project shall be constructed in substantial conformance to plans approved by the Planning Commission and on file with the Department of Community Development.2. Within two days of the final approval of this project,the applicant shall deliver to the Planning Division a cashier's check payable to the County Clerk, in an amount required to fulfill the fee requirements of Fish and Game Code Section 711.4(d) (2) and the county administrative fee, to Notice of Determination required under Public Resources Code 21152 14 Cal. Code Regulations 15075. If it is determined that there will be no impact upon wildlife resources, the fee shall be $25.00. If the applicant has not delivered the required fees within such two day period, the approval for the project granted herein shall be void. 3. The Design Review Board shall review and approve final building elevations, perimeter fencing, and landscaping plans prior to issuance of building permits. 4. The developer shall notify and receive approval and list of requirements from the Santa Fe Pacific Pipe Line Company prior to submittal of grading plans for city approval. Verification of Pipeline Company approval and requirements shall accompany grading plan submittal. 5. Prior to issuance of a building permit, a grading plan shall be review and approved by the City's Department of Public Works. 6. Prior to issuance of Grading or Building Permits the applicant shall obtain approval from the property owners to remove the existing block wall on the residential parcels along the site's westerly property line. On the southerly portion of the site, the applicant shall built a wall with a maximum height of 6', measured from the highest grade side. For the northerly portion of the site (adjacent to proposed Building "C") the applicant shall remove the existing earth to eliminate the load on the existing division wall in a manner approved by the city Engineer. The applicant shall be responsible for maintaining the landscaping area between proposed Building "C" and the site's westerly property line. 7. The developer shall remove the existing billboard, located at the southeast corner of the site and adjacent to Chapman Avenue, prior to the issuance of any building or grading permits. 8. The Chapman Avenue driveway approach shall be to provide emergency access only, and it shall be constructed to the specification of the Fire, Police, and Public Works Departments. 9. Upon voluntary stipulation, applicants agreed not to convert the property described herein to multiple family residential use and to cause a deed restriction to that effect to be recorded. 10. The self storage facility shall be open to the public only from 7:00 A.M. to 7:00 P.M. daily. 3 11. Building faces visible from McPherson Road shall be designed to discourage graffiti and shall have an architectural treatment which includes the use of anti- graffiti paint. 12. There shall be no outdoor recreation vehicle storage permitted on the property. 13. Prior to issuance of building permits, the applicant shall submit for and receive approval of a lot line adjustment for the land swap with the owner of the office building to the east of his site and the purchase of land from the city of Orange. 14. utilities supplied to individual storage buildings is limited to electric power for lighting purposes only. Electric receptacles for individual storage spaces are prohibited. The use of private electricity generators shall also be prohibited. The following code provisions are applicable to this project and are included for information only. This is not a complete list of requirements, and other Code provisions may also apply. Fencing shall not exceed zoning ordinance height standards (6' as measured from the highest adjacent grade). Construct street improvements, including pavement, curbs, and sidewalk, along McPherson Road frontage to comply with City street standards. Developer shall establish Best Management Practices for elimination of storm water runoff contamination, in compliance with standards in effect at time of permit issuance. Prior to issuance of building permits, applicant shall pay all applicable development fees, including but not limited to: Transportation System Improvement Program, Police and Fire Facility, Park Acquisition, Sanitation District, School District, Major Thoroughfare and Bridge Program, Library Facilities Fees. The following requirements shall be complied with to the satisfaction of the City'S Police Department and other Departments as noted. The structure shall comply with the requirements of Municipal Code - Chapter 15.52 (Building Security Standards), which relates to use of specific hardware,doors, windows, lighting, etc. (Ord. 7-79) "Approved Products List 5/93" is available. Approved structural drawings shall include sections of the security code that apply. Specifications, details, or security notes 4 may be used to convey the compliance. reviewed in a plan check by the Crime prior to approval. Provide Crime Prevention Bureau with lighting photometrics for required parking/access areas. This shows compliance with the minimum maintained one foot- candle on-site. The 4 inch address shall be illuminated and contrasting in color to the background displayed by front entry doors to each unit.Each storage building shall prominently display a building identification letter ("A" "B" etc.) at each end, and each unit within shall display a unit number 100" etc.) to assist in location of units for police response and crime analysis.Interior walls between all storage units shall be of a design prohibiting access to neighboring storage units.Walls shall extend from floor to ceiling, be of an approved material, and fastened in a manner to prohibit disassembly from a single side.Vents in walls or doors shall be protected against disassembly, and shall be designed to deny access into storage units.Doors to interior storage units shall be designed to secure the units against forced entry attacks. Doors,hinges, locking hardware shall meet the approval of the Crime Prevention Bureau. utilize concepts of Ord. 7-79 Building Security Standards) related to exterior doors.All landscaping shall be maintained not to interfere with required illumination and The following requirements shall be complied with to the satisfaction of the city's Fire Department and other Departments as noted. An approved fire sprinkler system must be installed throughout the building per O.M.C. 15.32.080 section 10.306(a). The system shall be designed per N.F.P.A. 13 or 13R, N.F.P.A., U.B.C. chapter 38 and U.B.C. standard 38-1. The sprinkler system requires 24 hour supervision.The Fire Department connection shall not be affixed to the building. The fire department connection must be located at least 40 feet away from the building, within 40 feet of a fire hydrant and on the address side of the building, unless otherwise determined by the fire department. The hydrant shall be located on the same side of the street as the fire department connection.Provide four on-site fire hydrants and mains capable of supplying the required fire flow. The hydrant model and on-site location shall be approved by the Fire Department and have a 3' minimum clearance around the circumference of the fire hydrant. The on-site hydrants shall be controlled by the control valve P.I.V.) for the sprinkler system so that water flow to hydrants is not impaired should the sprinkler system be shut down for any reason. U.F.C. 10. 206 and 10.301.Plans must be submitted to the Building Department.Prior to issuance of a fire service (detector check)the required water supplies for hydrants and fire sprinkler systems shall be determined and the water supplies shall be approved by the Fire Department.structures having a floor area as per Uniform Building Code Section 505, greater than 500 square feet but not greater than 5,000 square feet on anyone story, shall have installed therein an approved supervised fire detection system (heat detectors). OMC 15.32.010 Section 14.104 (J).When fire sprinkler systems are required in buildings of undetermined use, they shall be designed and installed to have a sprinkler density of not less than that required for an Ordinary Hazard Group 3 use with a minimum design area of 3,000 square feet.Every building shall be accessible to Fire Department apparatus by an access roadway of not less than 20 feet of unprotected width having a minimum of 13 feet 6 inches of vertical clearance. The access roadway shall be extended to within 150 feet of all po~tion. o~ the exterior walls of the first story of any building.U. F. The Fire Department access roadway shall be an all weather driving surface capable of supporting the imposed loads of fire apparatus. U.F.C. 10.207. Fire Department emergency access must be continuously paved to accommodate 40,000 pounds. Fire access lanes are to be posed and red-curbed. The sign which restricts parking shall be not less than 17 X 22 inches in size with lettering not less than one inch in height. The sign may also indicate that a citation may be issued for parking violations (C.V. C.22658). The sign shall say "NO PARKING TOW AWAY"and "UNAUTHORIZED VEHICLES WILL BE TOWED AWAY AT VEHICLE OWNERS EXPENSE". The sign or signs shall display the telephone number of the City of Orange Police Department. The sign shall also display the California Vehicle Code C.V.C. 22658 and O.M.C. section 15.32. 010.Approved address numbers shall be placed on the building to be plainly visible and legible from the street or road fronting the property and contrast with their background.One 2A 10 BC rated fire extinguisher shall be provided for every 3,000 square feet of the building or 75 feet of travel distance.Any and all mechanical gates shall be provided with a key-operated override per City of Orange Ordinance 8-9-84.
