RES-8383 Ordering Vacation and Abandonment of Portion of Santiago Canyon Road EasementRECORDING REQUESTED BY AND ItlAIL TO: City of Orange City Clerk's Office 300 E. Chapman Ave. Orange, CA 92666 RESOLUTION NO. 8383 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE ORDERING THE VACATION AND ABANDONMENT OF THAT PORTION OF THE SANTIAGO CANYON ROAD EASEMENT AT 8001 E. SANTIAGO CANYON ROAD. WHEREAS, the City Council of the City of Orange did, on the 23rd day of August, 1994, adopt Resolution No. 8380 entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE GIVING NOTICE OF THE I~ENT TO VAC~TE ~~ ~B~~ON A POR~~O~ OF THE SANTIAGO CANYON ROAD AT 8001 E. SANTIAGO CANYON ROAD. WHEREAS, in Resolution No. 8380 the Council declared its intention to vacate and abandon and close to public use a certain portion of an easement for street purposes upon, over, across, along and through the hereinafter described property in accordance with the Public streets, Highways and Service Easements Vacation Law, California streets and Highways Code section 8300 et seq; and WHEREAS, the proposed vacation and abandonment is in conformity with the City'S adopted general plan pursuant to the requirements of section 8313 of the Streets and Highways Code; and WHEREAS, Resolution No. 8380 was published on September 1, 1994, in the orange Independent, a newspaper of general circulation, printed, published, and circulated in the city of Orange, County of Orange, State of California; and WHEREAS, by Resolution No. 83eO, the City Council directed that notices of the hearing on the matter of the vacation, abandonment and closing to public use of that portion of said easement for road purposes be posted conspicuously along the line of said easement in a manner required by law; and WHEREAS, Daniel Saucedo, Street Division, Department of Public Works, did On the 25th day of August, 1994, post conspicuously not less than three (3) such notices along the lines of that portion of public street to be abandoned, which notices were posted less than 300 feet apart and were posted at least two (2) weeks before such hearing; and WHEREAS, the City Council did at the Council Chambers, Civic Center, 300 East Chapman Avenue, in the City of Orange, conduct a public hearing on the matter of whether that portion of said easement for road purposes hereinafter described, should be vacated, abandoned, and closed to public use, and at the hearing heard evidence, thereafter closing the public hearing; and WHEREAS, the City Council finds from all evidence submitted that the portion of the easement for road purposes described in the Resolution of Intention and hereinafter described, is unnecessary for present or prospective road purposes and that an order vacating and abandoning such easement should be made. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange, as follows: 1. That it finds the foregoing recitals to be true. 2. That it finds from all evidence submitted that the easement for road purposes described in the attached exhibits is unnecessary for present or prospective public purposes. 3. That all existing public utility easements, that is to say water, sewer, telephone, cable television, electrical, gas, etc., shall be reserved. It is the intention that existing public utility easements shall not be vacated and abandoned. 4. That it does hereby order that the described easement for road purposes be hereby vacated, abandoned, and closed to public use on the date when all conditions precedent have been satisfied. 5. That the portion of the described easement ordered vacated, abandoned, and closed for public use is that certain easement described in Resolution No. 8304, is situated in the City of Orange, County of Orange, state of California, and is more particularly described in Exhibit "A" and shown on the map included as Exhibit "B". Said exhibits are attached hereto and made a part hereof. Exhibit "B" shall not be published. BE IT FURTHER RESOLVED that the city Clerk be, and she is hereby authorized and directed to cause a certified copy of this Resolution and Order, attested by her under the seal of the City of Orange, to be recorded in the Office of the County Recorder of Orange County, California, upon all conditions precedent having been satisfied.
