A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE UPHOLDING THE RECOMMENDATION
OF THE PLANNING COMMISSION OF THE CITY OF
ORANGE AND APPROVING THE GENERAL PLAN
CLASSIFICATION OF PROPERTY LOCATED AT
236 AND 250 SOUTH TUSTIN STREET.

RECITALS:After due public hearings as required by law, the
City council of the City of Orange considered a recommendation
of the Planning Commission of the City of Orange
recommending,by Resolution No. PC-19-94, that
certain property situated at the northwest corner of Tustin
Street and Washington Avenue, more particularly described as 236
and 250 South Tustin Street, be redesignated from
the Low Density Residential designation to the General
Commercial Land Use designation, and approved said
recommendation after finding and determining the hereinafter described
facts. The real property which is the subject of the
redesignation is more particularly
described as follows:Lot 19 of Tract No. 2628, as shown on
a Map recorded in Book 77, Page 26 of
Miscellaneous Maps, records of
said Orange County.During the public hearing, the City
Council found the
facts as follows:1. The subject parcels are two of
the few remaining residentially zoned properties with
frontage on Tustin Street. They are located at the
northwest corner of Tustin Street and Washington Avenue,
and have a combined area of 16,400 square feet (just
over 1/3 acre). Each lot contains a
single family residence,one originally constructed in 1925 the
other in 1955.2. The applicant states that he intends
to construct a medical office building on the property, which
is a use that would be allowed under
the
OP zoning classification.3. The properties immediately adjacent to
this site which also have frontage on Tustin Street are
zoned OP. The adjacent properties to the west (rear)
are zoned R-I-6 and
4. The General Plan designation of the site is Low Density
Residential; the adjacent parcels facing Tustin street
are designated General Commercial. The General
Commercial designation permits a wide range of
commercial activities, and both OP and C-1 zoning
would be consistent with this designation. The General
Plan Amendment is necessary to maintain consistency
between zoning and the General
Plan.NOW, THEREFORE, BE IT RESOLVED by the city Council
of the City of Orange that the recommendation of the
Planning Commission be upheld and that General Plan Amendment
No.1-94, redesignating the subject property to
the General Commercial Land Use category be approved for
the
following reasons:1. Tustin street is an augmented primary
arterial highway,more suitable for commercial and office uses
than for residential development. The adjacent
parcels with frontage on Tustin street are
designated General Commercial. Therefore, a change from
Low Density Residential to General commercial is
consistent with general land use trends along the
Tustin street corridor and within the
immediate area.2. A corresponding zone change has been
requested, to ensure consistency between the General Plan
and zoning.ADOPTED this 12th day of
