RES-8333 Declaring Surplus Real Property and Setting Forth Conditions of SaleRESOLUTION NO. 8333 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE DECLARING SURPLUS THAT CERTAIN VACANT PARCEL OF REAL PROPERTY SITUATED ON THE SOUTH SIDE OF SANTIAGO CANYON ROAD ACROSS FROM HUNTERS WAY AND SETTING FORTH THE CONDITIONS FOR SALE OF SAID PROPERTY. WHEREAS, the City of Orange is the owner of that certain parcel of real property described in Exhibit "A" and shown on a map denoted as Exhibit "B"; both of which are attached hereto and made a part hereof; and WHEREAS, the City of Orange heretofore determined that it was necessary to acquire this property inasmuch as the City had determined to widen Santiago Canyon Road thus compelling the existing house and garage to be demolished. WHEREAS, the parcel is approximately 24,299 square feet in size, substantially smaller than required by the R-I-40 zone; but does exist as a legal building size.NOW, THEREFORE, BE IT RESOLVED that the City of Orange does hereby declare that certain parcel of real property described herein and attached hereto as set forth in Exhibits" A" and "B" to be excess to City needs and does hereby state its intention to sell said real property "as is" and subject to all covenants, conditions, restrictions;rights; rights-of-way and easements of record or otherwise existing.BE IT FURTHER ~SOL VED that said real property shall be sold in accordance with the following conditions:1. Said property will be sold at the best price bid on September 8, 1994.However, the minimum price bid must be at least $204,000.00.2. The property will be sold for cash only, the City will not participate in any other financial arrangements.3. The City of Orange will not pay any real estate commissions on the sale of said property.4. The First American Title Insurance Company of Santa Ana or a mutually acceptable escrow company will act as escrow officer, and the total escrow cost shall be borne by the purchaser. However, an owner's policy of title insurance will be provided to the purchaser by 5. Escrow shall be completed on or before December 15, 1994, or earlier, upon mutual agreement of both parties. Following award by the City Council, if the successful bidder fails to complete the escrow, the check deposited with the bid shall be forfeited to the City of Orange and bidder shall forfeit all rights to purchase said property. 6. All bids, shall be accompanied by a cashier's check in the amount of 10,000.00 made payable to the City of Orange, no othertype of check will be acceptable. The deposit of the successful bidder will be retained by the City and applied to the Purchase price, all others will be returned. 7. Written bids for the purchase price of said property shall be received by the City Clerk on or before 2:00 p.m. on September 8, 1994. There will be no oral bidding. 8. The City Clerk shall open all sealed proposals, examine same and notifY the City Council of the results. The Mayor shall announce the decision of the City Council at the 3:00 p.m. meeting of the City Council on September 13, 1994. 9. The City Council may select the highest bid, or if it deems such action be for the best public interest, reject any and all written bids and withdraw the property from sale.
