RECITALS: After report thereon by the zoning Administrator and after due public hearings as required by law relating to variance 1964- 94, a request to allow creation of a lot containing less than the minimum lot size required by code, city Council considered the decision rendered by the Zoning Administrator and denied Variance 1964-94. Said real property is more particularly described as follows:460 N. Milford Road Upon the public hearing before the City Council, the following facts were established:1. The applicant is proposing to subdivide his 10, 790 sq. ft. parcel into two parcels, one 6,000 sq. ft. and the other 4,790 sq. ft. The larger of the parcels would contain the applicant's existing residence while the new parcel could be developed with a single family residential structure. The subject site is zoned R-1-6 Residential, single family, minimum lot size 6,000 sq.ft.) and is located at the southwest corner of Milford Road and Walnut Avenue (460 N. Milford Road).2. The applicant is requesting a variance to allow the creation of a parcel with lot area less than the minimum lot size allowed by the site's zoning classification, R-1-6.3. The proposal would create two parcels with lot area less than the approximately 7,200 sq. ft. average lot area for the 46 properties within 300' of the subject site. Also, of the 46 properties within 300 feet of the subject site, the smallest two parcels are 6,000 sq. ft., while the remaining 44 parcels range in size from 6,500 to 11,000 sq. ft.4. The subject site is bordered on the north by a cleared area that is part of the Walnut Avenue right-of-way. The City's Public Works Department has indicated this area is presently developed with an underground storm drain and is used for access by maintenance crews for Costa Mesa) Freeway. Also, this area may be needed for the replacement Walnut Avenue freeway overpass when the 55 Freeway is widened.
