A RESOLUTION OP THE CITY COUNCIL OP THE
CITY OP ORANGE AMENDING SECTION 13.60.020
AND SECTION 13.60.030 AND SECTION 13.60.040
OP THE ORANGE MUNICIPAL CODE CHANGING CERTAIN
SANITATION AND SERVICE CHARGES BY CONTRACTOR.
WHEREAS, section 13.60.015 of the Orange Municipal Code
provides that charge adjustment in section 13.60.020, section
13.60.030 and section 13.60.040 may be made by Resolution of the
City Council; and
WHEREAS, the California Integrated Waste Management Act of
1989, commonly referred to as AB 939, requires that local agen-
cies implement an integrated waste recycling program that
includes recycling and other means to divert 25% of their solid
waste from land disposal by 1995 and 50% thereof by the year
2000; and
WHEREAS, to implement said strategy and to meet the waste
diversion and related obligations imposed on local agencies by AB
939, the city's Solid Waste Contractor has proposed to construct
and operate a materials recovery facility (MRF), also known as a
Solid Waste Transfer and Processing Facility to be located at
2050 North Glassell Street, City of Orange; and
WHEREAS, City's Solid Waste Contractor entered into a Memo-
randum of Understanding with the city contemplating a later
definitive agreement and outlining their intentions with respect
to a solid waste transfer and processing facility which city's
Solid Waste Contractor or its affiliates propose to construct and
operate in the City of Orange, and assuring the City a
substantial interest in, and the first right of use of the MRF,
compliance with AB 939 and reductions in anticipated costs of
such compliance compared to use of other available facilities;
and
WHEREAS, the City Council after due notice and opportunity
for the public to be heard on the matter in a public meeting in
compliance with State Law finds that the cost of the MRF
operating expenses are both a proper expenditure of public funds
and a cost effective means of complying with State Law; and
WHEREAS, the City Council has determined that changes for
sanitation and sewage services charged by City shall be changed
as set forth herein to become effective March 31, 1994.
NOW, THEREPORE, BE IT RESOLVED by the City Council of the
City of Orange as follows:

Amend Section 13.60.020, section 13.60.030 and section

13.60.040 of the Orange Municipal Code to read as follows:
13.60.020 Charqes in Connection with Sanitation and Sewaqe
Svstem. The City furnishes to its residents services and
facilities in connection with its sanitation and sewage system,
and other services to provide a clean and healthful environment.
For such services and facilities, the following charges are fixed
to premises to which a sewer main is available:
A. Single-family dwelling, $13.04 per
month.B. Single-family dwelling units in any
duplex, double house, and other buildings containing only
single-family dwelling units, $13.04 per
month per unit.C. Apartment house, $9.50 per unit per
month where bin service is utilized; $13.04 per unit per month
where bin service is not utilized. When the Director of
Public Works determines that it is not reasonably possible to place a trash
bin at an active water meter service for a building
generating trash in excess of five 45-gallon containers per week,
the charge for each unit of such mUltiple-family
building shall be an additional 13.
04 per month per unit.D. Hotel, motel, bungalow court, or
auto court, $9.50 per month for each dwelling
unit therein with cooking facilities where bin service utilized; $13.04 per
unit per month where
bin service is not utilized.E. Hotel, motel, bungalow court, or
auto court, $1.00 per month for each dwelling unit
with private toilet facilities only,other than a dwelling unit
described in Subsection D above.F. For each water closet
in any hotel, motel, bungalow court, or auto court other than a
water closet in any dwelling unit in Subsections d and E hereof, the sum
of $9.50 per water closet where bin service is utilized; $13.

month, together with $1.00 per

utilized, $13.04 per month.J. Trailer camps or trailer parks, $
13.04 per month for each trailer space; provided that if
any such trailer camp or trailer park utilizes bin service, rate shall be $
9.50 plus $1.00 per
month for each trailer
space.
K. For all other prem~ses not specifically mentioned in
this section where such prem1ses are occupied by one or more
persons, or is used for commercial, professional, manufacturing,
or processing purposes with sanitary plumbing facilities, where
bin service is utilized, $9.50 per month; where bin service is
not utilized, $13.04 per month, plus $1.00 per month for each
additional water closet.
L. For condominiums and townhouses with individual water
meters and utilizing bin service, $4.30 per month per unit; where
bin service is not utilized, $13.04 per month per unit.
M. For all other premises not specifically mentioned in
this section and do not utilize trash service from the City's
Contractor, $4.30 per month per unit.
N. Materials Recoverv Facilitv Surcharqe
1. A Materials Recovery Facility (MRF) surcharge applicable to
each class of sanitation and sewage charge set forth in
subsections A through M in an amount sufficient to pay debt
service and principal reduction on the cost of building and
equipping the MRF for the city of Orange. Such surcharge shall
be based on the total number of units billed during the prior
year divided into the total amount of debt service and principal
reduction assessed to the city for the MRF. The initial per unit
surcharge shall be $2.25. The monthly surcharge shall be
adjusted annually as of January 1st of each year to reflect any
changes in the total number of units billed. The city Manager or
his designee shall report to the City Council on or before
December 1st of each year concerning any adjustments necessary in
the surcharge. Any reductions in the surcharge contained in the
City Manager's report shall take effect as of January 1st of the
succeeding year without further Council action unless overridden
by the Council prior to that date. Any increase in the surcharge
for any year shall be established by resolution of the City
Council after such notice and hearing as may be required by State
Law.
2. The surcharge shall terminate upon the termination of the
city's obligations to pay for debt service and principal
reduction for the MRF. Any excess remaining in the surcharge
fund upon termination shall be applied to reduce the City'S
obligation for operational costs of the MRF for the benefit of
rate payers under this section.
13.60.030 Trash DisDosal Contractor - Charqes. The city's Trash
Disposal Contractor may charge for other than regular residential
service in accordance with the following schedule;charges
shall include a service rate and a Material Recovery Facility (
MRF) rate; the MRF rate shall include an MRF processing cost
and a gate fee cost component:3-

The term bale shall be defined as: "Refuse that has been
manually or mechanically compacted, compressed, processed, tied,
bundled or sealed into units weighing in excess of 100 pounds,
but shall not exceed 2000 Ibs. per bale."
SPECIAL BIN CLEANING SERVICE
20.00 Bin cleaning service charge per bin.
13.60.040 Charaes to Premises without Sewer Mains. For each
residential unit, commercial unit, or industrial unit to which a
sewer main is not available where such premises is occupied by
one or more persons or is used for professional, commercial,
manufacturing or processing purposes, charges shall be $12.32 per
month.
