RES-8301 Partially Approving Zone Change No. 1164-93RESOLUTION NO. 8301 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE PARTIALLY APPROVING A ZONE CHANGE REQUEST FROM M-1 (LIGHT MANUFACTURING), C-2 GENERAL BUSINESS) AND R- 3 (RESIDENTIAL MULTIPLE FAMILY) TO A SPECIFIC PLAN DESIGNATION THAT IDENTIFIES LOCATIONS FOR MULTIPLE FAMILY,RESIDENTIAL MIXED USE, COMMERCIAL, PUBLIC FACILITIES, OPEN SPACE PARK AND LIGHT INDUSTRIAL ON PROPERTY LOCATED ON THE NORTH AND SOUTH SIDES OF CHAPMAN AVENUE BETWEEN PIXLEY AND OLIVE STREETS, BOTH SIDES OF THE 100 AND 200 BLOCKS OF NORTH CYPRESS AND LEMON STREETS,THE EAST SIDE OF THE 100 BLOCK OF NORTH PIXLEY STREET AND THE EAST SIDE OF THE 300 BLOCK OF NORTH CYPRESS STREET. Zone Chanae 1164- 93 City of Oranae RECITALS:WHEREAS, the City Council of Orange has heretofore adopted a general plan with the various elements enumerated by state law; and WHEREAS, Section 65450 et seq. of the Califomia Government Code provides the authority and procedures for the adoption by the City of a specific plan or plans to further implement the City's adopted general plan; and WHEREAS, the City has determined to implement the specified procedures for the adoption of a specific plan for the area surrounding the Historic Santa Fe Depot in the City of Orange; and WHEREAS, the City Council did hold a duly advertised public hearing on September 21, 1993, to consider a zone change, including Planning Commission recommendation, from M-1 (Light Manufacturing), C-2 (General Business) and R-3 (Residential Multiple Family)districts to a Specific Plan designation that identifies locations for Multiple Family Residential,Mixed Use, Commercial, Public Facilities, Open Space Pari<, and Light Industrial on properties surrounding the Historic Santa Fe Depot.WHEREAS, the City Council reduced the area included in said General Plan Amendment to that reflected in attachments "A," "B," "C," "0" and "E."WHEREAS, the City Council concurs with the finding of the Environmental Review Board that the Zone Change (Specific Plan) will not have a significant impact on the environment NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Orange partially approves Zone Change 1164-93 as follows: Rezone that portion of the study area south of Maple Avenue from M-1 (Light Manufacturing) and C-2 (General Business) to Specific Plan designations that identify locations for mixed use, commercial, public facilities and open space-park while retaining existing zoning of M-1 (Light Manufacturing) on that portion of the study area north of Maple Avenue, for the following reasons:1. Change in use for the area south of Maple Avenue from industrial and automotive uses to retail commercial and mixed use is appropriate based on the development of a new commuter rail station, reuse of the original Depot building as a restaurant and refurbishing of the small park adjacent to the Depot building, and the need for additional people serving commercial uses that would relate to the rail station and Old Towne Plaza District.2. Change in use for the area north of Maple Avenue from industrial to multi-family residential is not appropriate at this time due to a lack of available project funding,concem for density adjacent to railroad tracks, relationship of proposed multi-family development to adjacent lower scale neighborhoods, and the need for further study of residential projects that might be considered at a future point in time when certain development issues are more specifically addressed.
