RES-8567 Consenting to Acquisition of Certain Real Property by Eminent Domain ProceedingsRESOLUTION 8567 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE CONSENTING TO ACQUISITION OF CERTAIN PROPERTY BY EMINENT DOMAIN PROCEEDINGS BY QUASI- PUBLIC ENTITY, CHAPMAN UNIVERSITY. WHEREAS, pursuant to the provlSlons of California Education Code Section 94500 (formerly Section 30051) an educational institution of collegiate grade within this State not conducted for profit may acquire by eminent domain any property necessary to carry out any of its powers or functions; and WHEREAS, pursuant to Code of Civil Procedure Section 1245.320 Chapman University is a quasi-public entity authorized to take property by eminent domain under said Section 94500 of the Education Code; and WHEREAS, the public use for which the property is to be taken pursuant to Education Code Section 94500 is for parking lot purposes necessary to carry out the educational powers or functions of Chapman University; and WHEREAS, the property sought to be acquired is situated in the County of Orange, State of California, and is more particularly described in Exhibit " A"attached hereto and by this reference incorporated herein; and WHEREAS, Chapman University will suffer a hardship if the acquisition of the property by eminent domain is not pennitted in that insufficient parking for its students will result.NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Orange hereby does find, detennine and declare as follows:SECTION I:The public interest and necessity require the proposed project.SECTION II.The proposed project is planned or located in the manner that will be most compatible with the greatest good and least private SECTIONllI: The property described in Exhibit" A" attached hereto is necessary for the proposed project. SECTIONlV: The hardship to the quasi-public entity if the acquisition of the property by eminent domain is not permitted outweighs any hardship to the owners of such property.SECTION V:The City Council of the City of Orange, hereby consents to the acquisition of that certain property described in Exhibit "A" attached hereto by eminent domain proceedings.ADOPTED this 12th day of December, 1995.i -' / I / I IeI i-~.
