A RESOLUTION OF THE CITY COUNCIL OF TIlE
CITY OF ORANGE, AUTHORIZING THE
APPLICATION FOR FUNDS FOR THE
TRANSPORTATION ENHANCEMENT ACTIVITIES
PROGRAM UNDER THE INTERMODAL SURFACE
TRANSPORTATION EFFICIENCY ACT OF 1991 FOR
TIlE SPRR TUSTIN BRANCH BICYCLE TRAIL
PROJECT.
WHEREAS, the United States Congress has enacted the Intermodal Surface
Transportation Efficiency Act of 1991, which is to make available over $200
million over a six year period as funds to the California Department of
Transportation for transportation enhancement activities; and
WHEREAS, the Department of Transportation has established the
procedures and criteria for reviewing proposals and, along with the Regional
Transportation Agencies, will submit to the California Transportation Commission
a list of recommended projects from which the recipients will be selected; and
WHEREAS, said procedures and criteria established by the California
Department of Transportation call for the approval of an application by the
applicant's governing body before submission of said application to the California
Transportation Commission; and
WHEREAS, the application contains assurances with which the City of
Orange, as applicant, must comply; and
WHEREAS, the City of Orange as applicant, if selected, will enter into an
agreement with the State of California to carry out the transportation enhancement
activities projects; and
WHEREAS, on November 14, 1995, the City Council of the City of Orange
considered proposed project nominations and authorized staff to submit
applications for Transportation Enhancement Activities funds; and
WHEREAS, staff will submit a project application within the -parameters of
the City Council's authorization; and
WHEREAS, a revised resolution is necessary to comply with the final
Transportation Enhancement Activities Guideline in that the City's commitment to
a dollar match amount must be stated and the resolution must reflect the project
application submitted.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Orange as follows:
Section I:
The filing of a Transportation Enhancement Activities program application
for the "SPRR Tustin Branch Bicycle Trail" project is hereby approved.
Section II:
The City of Orange's contribution will consist of $750,000 in non-
Federal funds for this project, donated by the landowner (Southern Pacific Railroad) in
the form of a write-down in the cost of
the land.
Section III:The City of Orange will make adequate proVlSlOns for
operation and maintenance of
the project.
Section IV:The City Council of the City of Orange hereby appoints the
City Manager as agent of the City to conduct all negotiations, execute and submit
all documents,including but not limited to applications, agreements, amendments
and payment requests, etc., which may be necessary for the completion of
the
aforementioned projects.ADOPTED this 28 th day of
