RES-8536 Approval of Vesting Tentative Parcel Map No. 94-185RESOLUTION NO. 8536 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE (upHOLDING) THE RECOMMENDATION OF THE PLANNING COMMISSION OF THE CITY OF ORANGE AND APPROVING) THE SUBDIVISION OF PROPERTY SITUATED AT THE SOUTHEAST CORNER OF CHAPMAN A VENUE AND YORBA STREET. VESTING TENTATIVE PARCEL MAP 94- 185 I.C.I. DEVELOPMENT COMPANY RECITALS:After report thereon by the Planning Commission and after due public hearings as required by law, and after receiving a recommendation from the Planning Commission, recommending, by Resolution No. PC 34-95, that the subdivision of property situated at the southeast comer of Chapman Avenue and Yorba Street be approved, the City Council considered Vesting Tentative Map 94-185 and determined that the recommendation of the Planning Commission should be upheld and Vesting Tentative Parcel Map 94-185 be approved. Subject property is more particularly described on Exhibit" A" attached hereto and hereby incorporated by reference.Upon the public hearing before the City Council, the following facts were found:1. On August 21, 1995, the Planning Commission considered a request to allow the subdivision of an existing 4.69-acre parcel as two distinct properties.The subdivision map would separate the existing Lucky supennarket and some of the parking area from the remainder of the multi-tenant commercial center, In May, 1994, the Planning Commission approved a related proposal to allow the supermarket's expansion, which required approval of a variance application and will require the relocation of a large Rusty Leaf Fig tree. The vesting tentative map marries the approved development to the subdivision map, allowing the property owner more 2. The Planning Commission recommends that the project be approved subject to seven conditions of approval, as listed within Resolution No. PC- 34-95.NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange that Vesting Tentative Parcel Map 94-185 be approved for the following reasons:1. The applicant's proposed subdivision and approved commercial development is consistent with the general plan, which is the only plan that is relevant to the local community,2. The Planning Commission identified nothing to suggest that subsequent development would pose a risk to public health, safety and welfare, as evident from prior evaluation of Negative Declaration 1456, which was previously determined to be adequate and complete.3. The proposed subdivision and approved commercial development is not known to conflict with state or federal regulations.4, With approval of Vesting Tentative Parcel Map 94- 185, the City Council would also affIrm an extension of time for prior approval of a request to expand a supermarket on this property, as requested by notes on the applicant's plan.BE IT FURmER RESOLVED that Vesting Tentative Parcel Map 94-185 be approved subject to the following conditions:1. A final parcel map shall be recorded within two years after tentative approval, and prior to the sale or lease of either parcel.2. Monuments shall be based on a survey,3. Dedicate bus bay as shown on tentative map and approved by City Traflic Engineer.4. Subject to reciprocal ingress/egress, drainage utility easements between parcels being recorded prior to the transfer of title of either parcel.5. Subject to a reciprocal parking agreement between parcels, as approved by the Community Development Department, being recorded prior to the transfer of title of either parcel.Reso, 6. Applicant shall, prior to final parcel map approval, provide evidence to the Building Division (Community Development Department) that proposed property line between existing buildings meets the requirements of building codes adopted by the City of Orange.
