RECOMMENDATION OF THE PLANNING
COMMISSION OF THE CITY OF ORANGE
GRANTING A CONDITIONAL USE PERMIT TO
ALLOW WEEKLY BINGO GAMES UPON
PROPERTY SITUATED AT 170 SOUTH OLIVE
STREET,

RECITALS:After report thereon by the Planning Commission and after due public hearings as
required by law, and after receiving a recommendation from the Planning Commission, that
Conditional Use Permit 2113-95 be granted to allow weekly bingo games upon property situated at
170 South Olive Street, the City Council considered Conditional Use Permit 2113-95
and determined that the recommendation of the Planning Commission should be upheld Conditional
use Permit 2113-95 be granted. Subject property is more particularly
described as follows:Lots 7, 8, the Northerly half of lots 9 and 10 and the Easterly 25 feet
oflot 19 in Block "R" of the Town of Orange, as per map recorded in Book 2,
Pages 630 and 631 of Miscellaneous Records of Los
Angeles, County, California.During the public hearing, the City Council found the facts more particularly
set
forth as follows:1. The applicant, Orange Elderly Services, Inc., is proposing to conduct
weekly bingo games at the Orange Senior Center located at 170
South Olive Street.2. The bingo games would be held on Friday nights from 6:30 p.m. to 10:30 p.
m. in the multi-purpose room and adjoining lounge area. The games will be open
to the public, and approximately 200 to 250 people are expected to attend. The games are to
be run by volunteers.A fee would be charged for the games, and cash prizes will be offered.
All the proceeds will benefit the Orange Senior Services, Inc. (a non-profit
organization). Since the senior center provides only 22 parking spaces on-site, it also relies on the
54 parking spaces within the adjacent City owned
public parking lot for additional parking.3. The applicant is also proposing to allow smoking at the
bingo games. Since a majority of the participants are smokers, the applicant proposes to
allow smoking in the larger multi-purpose room, and to maintain a smoke-free environment in
the smaller lounge area. The issue of smoking at this facility was raised at an earlier
meeting regarding this application, and the Council directed that staff address it during the
learned that smoking is regulated by State law (AB 13 - Smoke-Free Workplace Act); and that
the City is pre-empted from any decisions regarding smoking at this
location.4. At a regularly scheduled public hearing on June 19, 1995, the Planning
Commission recommended approval of this application for the following
reasons:A The proposed project would provide a recreation game to serve
the community, and would be a fund raising activity to enable the Senior Center
to provide needed services to the seniors of
Orange.B. The necessary conditions have been imposed with this project to assure
the safe operation and use of the facility, and to minimize any potential
adverse impacts to its surrounding
area.NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Orange that Conditional Use Permit 2113-95 be granted for the
following reasons:1. The proposed project would provide a recreation game to serve the
community, and would be a fund-raising activity to enable the Senior Center to provide needed
services to the
seniors of Orange.2. The necessary conditions have been imposed with this project to assure
the safe operation and use of the facility, and to minimize any potential adverse impacts to
its surrounding area.BE IT FURTHER RESOLVED that Conditional Use Permit 2113-
95 be granted subject
to the following conditions:1. Project shall occur in substantial conformance with plans as
approved by the Planning Commission, and as
modified by conditions herein.2. Project shall comply with all rules and regulations set forth in Chapter 5.
95 of
the Orange Municipal Code.3. The applicant must comply with all State laws regulating smoking in
the workplace
and/or public places.4. No bingo games shall be conducted concurrently with the
Orange International Street Fair.5. No advertising of the bingo games shall be permitted on premise where
it is visible from the
exterior of the building.6. Security shall be provided during the bingo games. The security may be
a volunteer of the organization conducting the games, and is not required to be
uniformed and/or licensed.7. If not utilized, Conditional Use Permit 2 I 13-95 shall expire two (
2)
years
