A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ORANGE ADOPTING GUIDELINES
RELATING TO IMPLEMENTATION OF THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT
WHEREAS, State law requires each city to adopt guidelines outlining its
administrative review process used to implement the rules and regulations contained in the
California Environmental Quality Act (public Resources Code Section 21000 et seq,), These
local guidelines supplement the State's CEQA Guidelines,
WHEREAS, Orange first adopted environmental review guidelines on May 9, 1973,
and later revised them on February 15, 1977; see attached City Council Resolution No, 4506,
Because the City's guidelines are outdated, this update is needed to reflect current procedural
policy.
WHEREAS, the updated guidelines have been organized so that they are more
readable and concise, and reference appropriate sections of the State CEQA Guidelines
rather than repeat requirements. They outline the environmental review process, from
determining whether an activity is subject to environmental review to preparing and
processing required documentation through the public hearing process, They also outline the
staff responsibilities in the review process and the approval authority.
WHEREAS, the notable changes from the 1977 guidelines include: 1) adding a
description of Community Development Department staff responsibilities; 2) designating the
Environ..nental Review Board as the Staff Review Committee to be consistent with the
changes proposed in the comprehensive update to the City's Zoning Ordinance; 3)
incorporating a description of the California State Department of Fish and Game
requirements; and, 4) adding an appendix that contains examples of CEQA application,
process flow charts, environmental forms, and environmental guides in order to clarify the
process requirements,
WHEREAS, the Planning Commission, at its meeting of March 6, 1995, reviewed
the proposed update of the City's Environmental Review Guidelines and recommended that
the City Council approve the adoption of the document.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Orange that the updated City Environmental Review Guidelines, which are attached hereto
and hereby incorporated herein, are adopted and shall be used to implement the rules and
regulations contained in the California Environmental Quality Act.
