RES-8480 Opposing Proposed Assembly Bill 182RESOLUTION NO. 8480 A RESOLUTION OF THE CITY COUNCIL OF mE CITY OF ORANGE OPPOSING PROPOSED ASSEMBLY BILL 182 (GRANLUND) PERTAINING TO PREEMPTION, LOCAL REGULATION OF SHOPPING CART RETRIEVAL. WHEREAS, Assembly Bill 182 (Granlund) Preemption, Local Regulation of Shopping Cart Retrieval will reach the Assembly floor within the next few weeks; and WHEREAS, abandoned shopping carts, similar to graffiti, are a blight on the local community; and WHEREAS, they can cause a hazard to traffic and pedestrians and can create a public liability when left on our City streets and sidewalks; and WHEREAS, it has been our experience that cart retrieval services and stores are often non responsive to the City's notifications; and WHEREAS, a 72 hour grace period allowing these hazards to remain on the public streets and sidewalks is poor public policy; and WHEREAS, this measure caps the maximum a grocer would have to pay cities at 5 for each retrieved cart which is far below the actual cost to the City to provide the service; and WHEREAS, the citizens of this community have expressed through letters and phone calls that there is a great expectation by the public to resolve this issue at the local level; and WHEREAS, this Assembly Bill appears to be a clear vote for special interest convenience at the expense of local control. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Orange strongly opposes the passage of Assembly Bi11182 (Granlund) Preemption, Local Regulation of Shopping Cart Retrieval for the above stated and other reasons.
