A RESOLUTION OF mE CITY COUNCIL OF mE
CITY OF ORANGE ORDERING CERTAIN CHANGES
AND MODIFICATIONS IN A SPECIAL ASSESSMENT
DISTRICT (AD 90-
1).WHEREAS, the City Council of the City Of Orange, California, has adopted
a Resolution pursuant to the provisions of Chapter4.5 of Division 12 of the Streets
and Highways Code of the State of California, and specifically Section 10353, (the "
Municipal Improvement Act of 1913"), declaring its intention to order certain changes and
modifications in the proceedings, boundaries and apportionment of assessments, and did, pursuant to law,
set forth a time and place for a public hearing on said proposed changes and modifications in
a special assessment district known and designated as Assessment District No. 90-
1 (Crawford Canyon) (hereinafter referred to as the "Assessment
District"); and WHEREAS, at this time notice of the public hearing on the proposed
changes and modifications has been given in the manner and form as required by
law; and WHEREAS, all protests, if any, have been heard and considered and a full
hearing has been given, all in the manner provided by
law; and WHEREAS, the owners ofone-half (1/2) of the area assessed have
not filed written protests against said proposed changes and modifications, and this legislative
body is now ready to proceed to take action on the proposed
changes and modifications.NOW, mEREFORE, BE IT RESOLVED by the City Council of the
City of
Orange as
follows:Section I:That the above recitals are all
true and
correct.Section II:That all protests and objections of any kind are overruled and denied, and
it is further determined that said protests and objections, if any, are made by the owners of
less than one-half of the area of property to be assessed for said improvements
within the
Section III:
That this legislative body hereby orders those changes and modifications as set forth in
a Resolution of Intention to order said changes and modifications, said changes to be approved
and generally listed as follows:
A. Amendment to boundaries to include properties now specifically benefiting
from the works of improvement based upon current land use and plans of development.
B. Approval and confmnation of assessments as modified, including
reapportionment of assessments on properties now receiving special benefit from the works of
improvement.
The decisions and determinations of this legislative body ordering the referenced
changes and modifications shall be fmal and conclusive upon all persons entitled to appear
thereon.
Section IV:
That the Amended Engineer's "Report", the amended Assessment Roll, and all related
documentation, as herein modified, are for the best interest of the property owners within the
Assessment District, and said modified "Report" shall stand as the Engineer's "Report" for this
Assessment District.
Section V:
That the assessments, as now reapportioned and filed in the Amended Engineer's
Report" and diagram for the improvements, together with appurtenances and appurtenant
work in connection therewith, are hereby approved and confIrmed.
Section VI:
That the City Clerk shall forthwith deliver to the Superintendent of Streets the amended
assessment, together with the amended diagram attached thereto and made a part thereof. The
Superintendent of Streets shall then immediately record said amended diagram and assessment
in his Office in a suitable book to be kept for that purpose and attach thereto his certificate
evidencing the date of such recording.

Section VII:
Upon approval of the amended boundaries and reapportionment, a certified copy of the
amended assessment diagram shall be immediately filed in the Office of the County Recorder.
Immediately thereafter, a copy of the amended notice of assessment shall be recorded in the
Office of the County Recorder in the manner and form as set forth by law and specifically
Section 3114 of the Streets and Highways Code of the State of California.
