RES-8453 Initiating Proceedings for Landscape Maintenance District No. 94-1RESOLUTION NO. 8453 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE INITIATING PROCEEDINGS AND ORDERING THE PREPARATION OF AN ENGINEER'S REPORT FOR CERTAIN ASSESSMENT DISTRICT PROCEEDINGS AD 94- 1)WHEREAS, the CITY COUNCIL of the CITY OF ORANGE, CALIFORNIA, at this time proposes to initiate proceedings for the formation of a special assessment district pursuant to the terms and provisions of the "Landscaping and Lighting Act of 1972", being Division 15, Part 2 of the Streets and Highways Code of the State of California, in what is known and designated as LANDSCAPE MAINTENANCE DISTRICT NO. 94-1 (hereinafter referred to as the Assessment District"); and,WHEREAS, there has been submitted for approval a map designated by the name of this Assessment District, generally showing the area and property to be assessed in said Assessment District; and,WHEREAS, this legislative body wishes to order the preparation of a " Report", as authorized by Section 22585 of the Streets and Highways Code of the State ofCalifomia.NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange, as follows:RECITALS Section I:That the above recitals are all true and correct.DESCRIPTION OF MAINTENANCE WORK Section 11:That the public interest and convenience require, and this legislative body does propose at this time to initiate proceedings for the formation of a special Assessment District for the installation, maintenance, and replacement of the following improvements and appurtenant work along the northerly and southerly upper banks of Santiago Creek and abutting publicly owned property:A. Ornamental shrubs, trees and ground cover;B. Habitat area including natural shrubs, trees and ground cover;C. Complete irrigation system including pipes, valves, sprink1er heads and controller;D. Complete bike trail including asphalt, signing, striping and lighting;E. Soil cement For particulars as to the location of said work, reference is made to the boundary map as previously approved and on file in the Office of the City Clerk. DESCRIPTION OF ASSESSMENT DISTRICT Section Ill: That said installation, maintenance, replacement and appurtenant work will provide a special and direct benefit to the property and parcels of land within the boundaries of the Assessment District, and for a general description of the area and boundaries of said proposed Assessment District, reference is made to a map previously approved by this legislative body and identified by the name of this Assessment District, which map is on file with the transcript of these proceedings and open for public inspection. REPORT OF ENGINEER Section IV: That this improvement is hereby referred to the SUPERINTENDENT OF STREETS, who is hereby directed to make and file the "Report" generally containing the following: A. An estimate of the costs of the installation, maintenance replacement and appurtenant work for the project and referenced fiscal year; B. A diagram for the Assessment District, showing the area and properties proposed to be assessed; C. An assessment spread of the estimated costs of the installation, maintenance replacement and appurtenant work, assessing the net amount upon all assessable lots and/or parcels within the Assessment District in proportion to the benefits received. Upon completion of the preparation of said "Report", the original shall be filed with the City Clerk, who shall then submit the same to this legislative body for its immediate review and consideration. FISCAL YEAR Section V: That the above "Report" shall include all costs and incidental expenses relating to the fiscal year commencing July I, 1995, and ending June 30, 1996. SPECIAL COUNSEL SERVICES Section VI: That Special Counsel services shall be provided by the law firm of Brown, Diven & Hentschke pursuant to an agreement between the City Council and said firm, setting forth terms and conditions for legal services relating to the formation of the Assessment District.
