RES-8451 Intent to Order Certain Changes and Modifications in Special Assessment District No. 90-1 Crawford Canyon RoadRESOLUTION NO. 8451 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE DECLARING ITS INTENTION TO ORDER CERTAIN CHANGES AND MODIFICATIONS IN A SPECIAL ASSESSMENT DISTRICT AND SETTING PUBLIC HEARINGS AD 90- 1)WHEREAS, the CITY COUNCIL of the CITY OF ORANGE, CALIFORNIA, has previously initiated proceedings and held a public hearing pursuant to the terms and provisions of the Municipal Improvement Act of 1913", being Division 12 of the Streets and Highways Code of the State of California, for an assessment district designated as ASSESSMENT DISTRICT NO. 90- 1 (CRAWFORD CANYON ROAD) (hereinafter referred to as the "Assessment District"); and,WHEREAS, at this time it appears to the legislative body that certain changes and modifications are necessary, and that, pursuant to the provisions of Section 10353 of said Streets and Highways Code, it is necessary that this legislative body adopt a Resolution briefly describing the proposed changes and giving notice of a time and place for two public hearings where persons may appear and show cause why said changes should not be ordered; and,WHEREAS, at this time it is determined to be in the best public interest and convenience to order a modification in the boundaries of the Assessment District and to provide for a reallocation of the costs and expenses to properly reflect the benefits received based upon current land use and allowable development; and,WHEREAS, there has now been presented to this legislative body for consideration and approval an amended boundary map showing the modifications to the boundaries to the Assessment District, as well as an amended Engineer's "Report" showing the reallocation of the costs and expenses to properly reflect the benefits received based upon current land use and allowable development.NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange as follows: Section I:That the above recitals are all true and correct. Section II:That an amended map of the Assessment District showing the boundaries of the proposed Assessment District and lands and property to be assessed to pay the costs and expenses of the proposed improvements designated as "AMENDED BOUNDARIES OF ASSESSMENT DISTRICT NO. 90-1CRAWFORDCANYON ROAD)" is hereby submimed, and the same is hereby Section Ill: That the original amended map of said boundaries of the Assessment District and one copy thereof is to be filed in the Office of the City Clerk. Section IV: A certificate shall be endorsed on the original and on at least one copy of the amended map of the Assessment District, evidencing the date and adoption of this Resolution, and within fifteen (15) days after the adoption of the Resolution fixing the time and place of hearings on the changes and modifications in said Assessment District, a copy of said amended map shall be filed with the correct and proper endorsements thereon with the County Recorder, all in the manner and form provided for in Section 3111 of the Streets and Highways Code of the State of California. Section V: That the amended Engineer's "Report" showing the reallocation of the costs and expenses to properly reflect the benefits received based upon current land use and the amendments to the boundaries is hereby approved and adopted. Section VI: That the original amended Engineer's "Report" shall be filed in the Office of the City Clerk and one (1) copy thereof to be filed in the Office of the City Engineer. Section VIl: That the public interest, convenience and necessity require, and it is the intention of this legislative body, to order certain changes and modifications in the proceedings, boundaries of this Assessment District and reallocation and distribution of costs and expenses to benefiting properties. Section VllI: NOTICE IS HEREBY GIVEN THAT TWO (2) PUBLIC HEARINGS ARE HEREBY SCHEDULED IN THE REGULAR MEETING PLACE OF THIS LEGISLATIVE BODY, BEING THE COUNCIL CHAMBERS, CITY HALL, ON THE FOLLOWING DATES AND TIME: A. FIRST PUBLIC HEARING: MARCH 28,1995 AT 4:30 P.M. (PUBLIC MEETING) B. SECOND PUBLIC HEARING: APRIL 11, 1995 AT 7:00 P.M. AT THAT TIME THE LEGISLATIVE BODY WILL HEAR ANY PROTESTS OR OBJECTIONS TO THE PROPOSED CHANGES AND MODIFICATIONS AS PROPOSED TO BE MADE BY THIS RESOLUTION. ANY INTERESTED PERSON MAY APPEAR BEFORE THIS LEGISLATIVE BODY AND SHOW CAUSE WHY SAID CHANGES AND MODIFICATIONS SHOULD NOT BE MADE IN ACCORDANCE WITH THE PROVISIONS OF THIS RESOLUTION. ANY OBJECTIONS MUST BE IN WRITING AND FILED WITH THE CITY CLERK BY ANY INTERESTED PERSON AT ANY TIME NOT LATER THAN THE TIME SET FOR THE PUBLIC HEARING. Section IX: That the City Clerk is hereby directed to certify to the adoption of this Resolution and cause a copy to be published once, not less than ten (10) days prior to the date set for the first Public Hearing. Said publication shall be in the ORANGE CITY NEWS, a newspaper designated for legal publications under these proceedings. Section X:The City Clerk is further directed to mail a copy of the Notice of Public Hearings to all persons owning real property within the boundaries of the Assessment District where assessments are adjusted based upon the reallocation of the costs to the names and addresses of such owners as the same appear on the last County Assessment Roll, or at the address as known to the City Clerk, not less than forty- five (45) days prior to the date set for the second Public Hearing.
