RES-8444 Granting Conditional Use Permit No. 2083-94RESOLUTION NO. 8444 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE UPHOLDING THE RECOMMENDATION OF THE PLANNING COMMISSION OF THE CITY OF ORANGE AND GRANTING A CONDITIONAL USE PERMIT TO ALLOW AN ACCESSORY SECOND DWELLING UNIT IN AN R-t DISTRICT UPON PROPERTY SITUATED AT 390 NORTH MAPLEWOOD STREET CONDITIONAL USE PERMIT 2083-94 WILLIAM AND GENEVIEVE SOUTHGATE AND RUTH BARRIOS RECITALS:After report thereon by the Planning Commission and after due public hearings as required by law, and after receiving a recommendation from the Planning Commission,recommending by Resolution No. PC-39-94, that Conditional Use Permit 2083-94 be granted to allow an accessory second dwelling unit in an R-I district upon property situated at 390 North Maplewood Street, the City Council considered Conditional Use Permit 2083-94 and determined that the recommendation of the Planning Commission should be upheld and Conditional Use Permit 2083-94 be granted. Subject property is more particularly described as follows:Lot 8 of Tract No. 1479 as per map recorded in Book 44, page 13 inclusive of Miscellaneous Maps in the Office of the Recorder, County of Orange.During the public hearing, the City Council found the facts as follows:I. The subject site is developed with a single story, single family residence with an attached single space garage. The existing residence is approximately 1,200 sq, ft.in size and its front entrance is off Maplewood Street. The site is located outside the City's Old Towne District.2, The applicant is proposing to convert the existing garage and a bedroom to an accessory dwelling unit and to build a new attached double garage. The proposal includes removing the existing driveway, paving the area to the rear of the garage for two open parking spaces and constructing a new driveway. The new residence will be 612 square feet in size and will contain one bedroom, one bathroom, a living room and a kitchen.3. The proposed building addition and exterior building remodel, including wall colors, building materials and window treatment, shall match those of existing residence.4, The property is zones R-I- 6 (Residential- Single Family District, 7,000 sq. ft.minimum lot size) and accessory second housing units are allowed by conditional use permit, with initial public hearing by the Planning Commission and S. The Planning Commission considered the proposal at a public hearing on October 17, 1994, and has recommended that the City Council approve Conditional Use Permit 2083- 94,NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange that Conditional Use Permit 2083-94 be granted for the following reasons:I. The project has been designed in a manner to minimize its impact on surrounding properties and therefore will not cause deterioration of bordering land uses or create special problems for the area.2. The project is recommended for approval subject to conditions which preserve the general welfare.BE IT FURTHER RESOLVED that Conditional Use Permit 2083-94 be granted subject to the following conditions:I, The project shall be constructed per plans approved by the Planning Commission and City Council, and which are on file with the Department of Community Development.2, Prior to occupancy of the accessory second dwelling unit, the property owner shall file an agreement with the Orange County Recorder stating that the property owner is required to live in either the main residence or the accessory second dwelling unit. The agreement shall also contain other requirements as imposed by the Planning Commission or City Council. Prior to filing the agreement with the County Recorder, the Community Development Department and City Attorney's office shall review and approve the agreement. The applicant shall provide the Department of Community Development with a copy of the recorded agreement for inclusion in the project fIle.3. Prior to issuance of building permits, grading plans shall be reviewed and approved by the Department of Public Works.4, The following code provisions are applicable to this project and are included for information only. This is not a complete list of requirements, and other Code provisions may also apply.Prior to issuance of building permits, applicant shall pay all applicable development fees, including but not limited to: Transportation System Improvement Program, Fire Facility, Police Facility, Park Acquisition, Sanitation District, School District, Major Thoroughfare and Bridge Program. The amount of various development fees shall be tabulated based on the fees that are in effect at the time building permits are issued,If not utilized within two years of final approval, Conditional Use Permit 2083- 94 shall expire.S. The following requirements shall be complied with to the satisfaction of the City's Police Department and other Departments as noted.The structure shall comply with the requirements of Municipal Code - Chapter IS,52 (Building Security Standards), which relates to use of specific doors, windows, lighting, etc. (Ord, 7-79) "Approved Projects List 5/93" is available, Approved structural drawings shall include sections of the security code that apply. Specifications, details, or security notes may be used to convey the compliance, This will be reviewed in a plan check by the Crime Prevention Bureau prior to approval,An illuminated address of 4 inches in height is required.
