A RFSOLUTION OF THE ORANGE REDEVELOPMENT
AGENCY AUTHORIZING THE EXECUTION OF A
COOPERATION AGREEMENT WITH THE CITY OF
ORANGE TO ACQUIRE SURPLUS CITY PROPERTY AT
THE NORTHWEST CORNER OF LA VETA AVENUE AND
MAIN STREET, AND APPROPRIATING $1,527,597 FOR
THE ACQUISITION
WHEREAS, by Ordinance No. 37-84 adopted on November 20, 1984, amended
by Ordinance No. 20-86 adopted on July 15, 1986, and amended by Ordinance
No. 24-88 adopted on July 12, 1988, the City Council of the City of Orange adopted
and approved a certain Redevelopment Plan (the "Redevelopment Plan") for the Southwest
Project Area, (
the Project"); and WHEREAS, pursuant to the Community Redevelopment Law of
the State of Califomia (Health and Safety Code Section 33000, et ~.),
the Orange Redevelopment Agency (the "Agency") is carrying out the Redevelopment Plan for the
Project in the redevelopment area (the "
Project Area"); and WHEREAS, in furtherance of the Project, the Agency and the City desire
to enter into a Cooperation Agreement in the form attached hereto (
the" Agreement"); and WHEREAS, the City acquired certain real property generally
located at 1425-1435 West LaVeta Avenue, 472-490 South Main Street for purposes
of street widening and has declared that a portion of that certain real property is not
needed for street widening purposes and is determined to
be surplus City property, and WHEREAS, the City desires to sell and the Agency
desires to acquire the surplus property generally located at 1425-1435 West LaVeta
Avenue, 472-490 South Main Street (the Subject Property"), which is more particularly described
in Exhibit A to the Agreement, to further
the implementation of the Redevelopment Plan:; and WHEREAS, the acquisition of the Subject Property
will be of benefit to the Project Area illl that it will enhance the area and contribute
to the elimination of blight throughout the Project Area, and in the immediate neighborhood in
which the Project Area is located; and WHEREAS, no other reasonable means
of financing the Subject Property are available to the eommunity in that the cost of the Subject
Property exceeds the financial ability of the City to pay, no private sources of funding ar(:
available, and all state and
NOW, THEREFORE, BE IT RFSOLVED, by the Orange Redevelopment Agency,
as follows:
1. The Agency hereby determines that the use o.f tax increment funds to purchase the
property is o.f primary benefit to the Project Area and finds that the effective
r,edevelopment o.f that portion of the Southwest Pro.ject Area adjacent to the Subject
Property requires the purchase of the Subject Pro.perty,
2. The Agency hereby accepts the conveyance o.f the Subject Property from the City and
hereby consents to. the acquisition o.f such Subject Property from the City fo.r a sum of
1,527,597 in accordance with the Agreement,
3. The Agency hereby appro.ves the Agreement and autho.rizes and directs the Chairman
and Executive Director to execute the Agreement and all such documents necessary or
a.ppropriate to effectuate its terms.
4. The Agency hereby appro.priates $1,527,597 fro.m Agency Fund No. 922 for the
acquisitio.n of the Subject Property from the City.
