RES-8657 Certifying Environmental Impact Report No. 1500-96 for Third Amendment to the Southwest Area Redevelopment PlanRESOLUTION NO. 8657 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE CERTIFYING ENVIRONMENTAL IMPACT REPORT NO. 1500-96 FOR THE THIRD AMENDMENT TO THE SOUTHWEST AREA REDEVELOPMENT PLAN AND ASSOCIATED GENERAL PLAN AMENDMENT AND REZONING,SUBJECT TO CERTAIN FINDINGS, APPROVAL OF A STATEMENT OF OVERRIDING CONSIDERATIONS,AND APPROVAL OF A MITIGATION MONITORING PROGRAM.ENVIRONMENTAL IMPACT REPORT 1500-96 WHEREAS, Environmental Impact Report No. 1500-96 (EIR 1500-96) has been prepared in accord with the California Environmental Quality Act (CEQA), the State CEQA Guidelines and the City of Orange Guidelines for the Implementation of CEQA;and WHEREAS, EIR 1500-96 has been prepared to address the environmental effects of the Third Amendment to the Southwest Redevelopment Plan, an associated General Plan Amendment to change the land use designation for ten ( 10) properties on the east side of Alpine Road between Culver and La Veta Avenues from "LDR-Low Density Residential" to "CG-General Commercial," and rezoning of the same properties from the R-I-6 (Residential-Single Family, 6, 000 sq. ft. minimum lot size) District to the C-2 General Business) District; and WHEREAS, EIR 1500-96 consists of the Draft EIR and the comments and responses to comments made on the Draft EIR; and WHEREAS, the Draft EIR was circulated for a 45 day public review period and a notice of its availability was published in a local newspaper, posted in the Office of the County Clerk and mailed to surrounding property owners and tenants; and WHEREAS, copies of the Draft EIR were distributed to the City Council, Planning Commission, WHEREAS, the Draft Environmental Impact Report reviewed and analyzed the following potential environmental impacts: Land use, including the existing and proposed setting of the site and consistency with land use regulatory policies and programs; Air quality, including short term construction impacts, long term operational impacts and cumulative air quality impacts; Traffic and circulation, including potential impacts to nearby critical intersections, arterial highways and local roads; Noise, including noise generated by nearby roadways, construction activities and commercial land uses; Visual effects, including the potential to create aesthetically offensive views or obstruction of scenic views or vistas. WHEREAS, a Final EIR was prepared, including responses to comments received on the Draft EIR; and WHEREAS, the City Council has reviewed and carefully considered the information contained in EIR 1500-96 and certifies it as an objective and accurate document on the basis that it reflects the independent judgment of the City in the identification, discussion, and mitigation of the project's environmental impacts; and WHEREAS, the required findings, attached hereto as Exhibit A and made a part hereof, can be made for each of the significant effects, which effects have been mitigated to a level of insignificance because changes or alterations have been required in, or incorporated into the project, which avoid or lessen its significant environmental effects; and WHEREAS, a Mitigation Monitoring and Reporting Plan has been prepared in accord with Public Resources Code 21881.6; and WHEREAS, no mitigation measures are available to reduce cumulative air quality impacts to an acceptable level; and WHEREAS, the required fmdings of Section 15091 of the State CEQA Guidelines can be made for each of the project's significant environmental effects, which effects cannot be reduced to an acceptable level, with regard to air quality; and WHEREAS, the EIR cannot be approved unless a Statement of Overriding Considerations is approved for the impacts to air quality as follows: 1. The project will increase the amount of land available for retail commercial and/or office land uses, thereby generating additional short and long tenn employment opportunities and improving the City's jobs/housing balance and providing economic benefit to the City; and 2. Future commercial and/or office development of the project site, consistent with a General Plan designation of "General Commercial" and a zoning designation of C-2 will allow for a comprehensively planned, modem development on the site; and 3. The proposed project has the potential to increase localized spending for goods and services which will in turn increase sales tax revenues to the City; and WHEREAS, the contribution of the project in meeting or achieving the goals and objectives of the General Plan, as amended, outweigh its unavoidable, adverse impacts; and WHEREAS, the City Council concurs with the above fmdings and Statement of Overriding Considerations.NOW, THEREFORE, BE IT RESOLVED, that the City Council hereby certifies that Environmental Impact Report No. 1500-96 as adequate, subject to the required findings and approval of a Statement of Overriding Considerations, and the associated Mitigation Monitoring Program.ADOPTED this 25th day of June 1996.ATTEST:J,& roAt4:r City Clerk of the Ity of I hereby certify that the foregoing Resolution was duly and regularly adopted by the City Council of the City of Orange at a regular meeting thereof held on the 25th day of June, 1996, by the following vote: AYES: NOES: ABSENT: Reso.
