RES-8650 Approving Minor Site Plan Review No. 3-96RESOLUTION NO. 8650 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE DENYING THE APPEAL OF APPROVAL OF MINOR SITE PLAN REVIEW NO. 3-96 AND APPROVING SAID MINOR SITE PLAN REVIEW FOR PROPERTY LOCATED AT THE SOUTHWEST CORNER OF RANCHO SANTIAGO BOULEVARD AND PEARL STREET.MINOR SITE PLAN REVIEW NO. 3-96 TONY ALVES WHEREAS, the Planning Commission conducted a public hearing to consider Minor Site Plan Review No. 3-96 for property located at the southwest comer of Rancho Santiago Boulevard and Pearl Street.WHEREAS, the proposed project is generally described as follows:The applicant, Duke Hoenshell, represented by Tony Ives, is proposing to demolish an existing residence and construct a minor automotive repair facility consisting of a 5. 014 sq,ft.building containing 5 service bays, two offices, two storage rooms, and two restrooms, The site will also be paved for 15 parking spaces, A pedestrian walkway and vehicle driveway will access the site from Rancho Santiago Blvd. The parking lot will have a gated entry and a 6' perimeter wall. The proposed service bays will face southward, towards Chapman Avenue. The proposed hours of operation are 8:00 AM to 6:00 PM Monday through Friday, and 9:00 AM to 1 :00 PM Saturday. The facility will be closed on Sunday.The subject site is located at the southwest comer of Rancho Santiago Boulevard and Pearl Street and is 15,200 sq. ft. in size, The site is designated on the City's General Plan Land Use Map as GC (General Commercial), and it is zoned C- 1 (Limited Business) District.The site is bordered by commercial uses to the west, south, and (across Rancho Santiago Boulevard) east, and single family residences to the ( across Pearl Street) north,The Site Plan Review process was established in September 1995 to provide a means of reviewing development projects to ensure that each project reflects the highest quality of land planning and design. The proposed automotive repair facility is a permitted use in the C-l Commercial) zone, and the site plan cornplies with all applicable development standards. The City's evaluation of this project is limited to site planning and building design elements of the project, not land use issues, since this is a permitted use,On January 24, 1996, the City's Staff Review Committee (formerly the Environmental Review Board) approved Minor Site Plan Review 3-95 to allow the applicant's proposal, The SRC's decision was based on the following: the proposed use is permitted in the C-1 District; The proposed site plan complies with the development adverse impacts of traffic and noise frorn the proposed use should be mitigated since the service bays face away from the nearest residences and access is from Rancho Santiago Blvd,; the proposed use will not generate a significant increase in traffic on Rancho Santiago Blvd.; and the proposed use and project design complies with the development standards contained in the EI Modena Chapman Avenue Improvement Plan. On February 6, 1996, residents living in the vicinity of the subject site appealed the SRC's decision for the following reasons (quoted from the appellant's appeal form): We are appealing this decision, because of the noise and traffic it will create. We were not notified that an auto shop would be built on this property, There were no signs posted, and no residents were notified. " WHEREAS, subject property is more particularly described as follows: A portion oflots 1, 3 & 5 in block B of Keller's Addition to the town of Modena as per map recorded in book 1, page 126, map records of Los Angeles County. WHEREAS, by Resolution No. PC 9-96, the Planning Commission approved Minor Site Plan Review No. 3-96 with certain findings and conditions of approval; and WHEREAS, Appeal No. 428, an appeal of the Planning Commission action on this matter was filed by Jeanette Palacio; and WHEREAS, the City Council heard the appeal of Ms. Palacio by conducting a public hearing on April 23, 1996; and WHEREAS, at said public hearing the City Council heard the testimony of appellant, the applicant as well as members of the public,NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange that Appeal No. 428 is denied and Minor Site Plan Review 3-96 is approved for the following reasons:1. That the proposed use will provide a service to the neighborhood.2. That the Zoning Ordinance permits this use in this location.3. That the proposed building's design and placement and the layout of the proposed pedestrian and vehicle access to the project will rninirnize potential adverse impacts on surrounding residential or commercial uses. Reso BE IT FURTHER RESOLVED that the following conditions are imposed with approval: 1. The site plan and building be developed as per plans approved by the Staff Review Committee and on file with the Department of Community Development. 2. Prior to issuance of building permits, the applicant shall provide final building elevations, building colors, signs, and landscaping and irrigation plans to the Design Review Board for their final determination. 3. The applicant is restricted to only auto services and repairs permitted under the OMC's definition of a "minor auto repair" facility, All auto services and repairs shall be conducted only inside the building and shall not be conducted in parking spaces or open areas, The applicant may wash cars as an accessory service to customers who are having their cars serviced, however, the applicant cannot provide car washes as a separate service. The applicant cannot provide auto detailing unless the Planning Commission approves a separate conditional use permit application, 4, The street frontage along Rancho Santiago Blvd, will be posted "No parking", 5, The hours of operation shall be Mondays through Fridays, 8 AM to 6 PM, and Saturdays 9 AM to 1 PM. 6, The electrical room shall have access from the exterior by n man door placed on the east facade of the building and the electrical room shall not have access to the interior of the building. 7, The interior of the service bays walls shall have sound reduction batting or other surface treatment above 4' and the air compressor equipment shall be placed in an insulated room with an STC rating of 45 and the equipment shall be of "'whisper quiet" design.
