RES-ORA-0344 Adopting Replacement Housing PlanRESOLUTION NO. ORA- 0344 A RESOLUTION OF THE ORANGE REDEVELOPMENT AGENCY ADOPTING A REPLACEMENT HOUSING PLAN FOR DWELLING UNITS PROPOSED TO BE REMOVED FROM THE LOW AND MODERATE INCOME HOUSING MARKET AS A RESULT OF THE REDEVELOPMENT OF PROPERTY BOUNDED BY CULVER DRIVE, MAIN STREET, LA VETA AVENUE AND ALPINE ROAD IN THE SOUTHWEST REDEVELOPMENT PROJECT AREA VVHEREAS, the Agency is a public body corporate and politic created pursuant to and exercising powers conferred by the California Community Redevelopment Law ( Health &Safety Code Section 33000 etseq.) (the "Law"); and VHEREAS, the Agency is considering the redevelopment of a portion of the Southwest Redevelopment Project area consisting of approximately 4.28 acres of real property bounded by Main Street on the east, La V eta Avenue on the south, Alpine Road on the west and Culver Drive on the north (the "Development Site"); and VHEREAS, the conceptual plan for the redevelopment of the Development Site requires the destruction of dwelling units presumably occupied by households of low and moderate income; and VHEREAS, the Law provides that whenever dwelling units housing persons and families of low- or moderate-income are destroyed or removed from the low- and moderate-income housing market as part of a redevelopment project, the redevelopment agency shall, within four (4) years of such destruction or removal, rehabilitate, develop or construct or cause to be rehabilitated, developed or constructed, for rental or sale to persons and families of low or moderate income, an equal number of replacement dwelling units at affordable rents within the redevelopment project area or within the territorial jurisdiction of the agency, in accordance with all of the provisions of Section 33413 ofthe Law; and NHEREAS, pursuant to Section 33413.5 of the Law, which requires redevelopment agencies to adopt a replacement housing plan prior to executing an agreement that would lead to the destruction of dwelling units from the low- and moderate- income housing market, the Agency has prepared a draft Replacement Housing Plan for the dwelling units proposed to be removed from the housing market (the "Replacement Housing Plan") in connection with the proposed redevelopment of the Development Site; and WHEREAS, the Replacement Housing Plan addresses the following: (1) the general location of the replacement housing to be rehabilitated or developed; (2) the number of units in the proposed replacement housing project; (3) the timetable for meeting the replacement housing plan's relocation, rehabilitation or replacement housing objective; (4) an adequate means of financing the replacement housing plan; and (5) a housing does not require the approval of voters pursuant to Article XXXIV of the California Constitution; and WHEREAS, in accordance with the Law, the Replacement Housing Plan has been available for public review and comment for a reasonable period of time. NOW, THEREFORE, BE IT RESOLVED that the Redevelopment Agency of the City of Orange does hereby find, determine and resolves that the Agency hereby adopts the Replacement Housing Plan for the dwelling units located within the Development Site, which sets forth the Agency's plan for replacing those units which will be removed from the low- and moderate-income housing market in connection with the implementation of the proposed Project.ADOPTED this 25th day of August, 1998.
