RES-8625 Approving Redevelopment Agency's Sale of Real PropertyRESOLUTION NO. 8625 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE CONSENTING TO AND APPROVING THE ORANGE REDEVELOPMENT AGENCY'S SALE OF REAL PROPERTY PURSUANT TO HEALTH AND SAFETY CODE SECTIONS 33430 AND 33431 AND MAKING CERTAIN FINDINGS WHEREAS, on December 16, 1992, the Orange Redevelopment Agency (the Agency") under the provisions of the California Community Redevelopment Law, purchased certain real property located at 4629/4649 East Walnut Avenue, Orange (the Site") with the intention of developing the Site in accordance with the Redevelopment Plan for the Southwest Project Area; and WHEREAS, the Agency has determined that development of the Site will no longer further the redevelopment objectives of the Agency and that, therefore, the Site should be sold; and WHEREAS, in the approximately four (4) months that the Site has been listed for sale, the Agency has received only four (4) offers on the Site; and WHEREAS, Grace Aou, or assignee (the "Purchaser") has submitted to the Agency a written offer to purchase the Site at a price which constitutes the fair market value of the Site (the "Purchase Offer"); and WHEREAS, pursuant to Sections 33430 and 33431 of the California Health and Safety Code, the Agency is authorized, with the approval of the City Council after a duly noticed public hearing, to sell or lease property without public bidding; and WHEREAS, on May 14, 1996, the Agency and City Council held a duly noticed joint public hearing on the proposed sale of the Site without public bidding, in accordance with the requirements of Health and Safety Code Section 33431, at which time the Agency reviewed and evaluated all of the information, testimony, and evidence presented during the joint public hearing; and WHEREAS, all actions required by all applicable law with respect to the propolled sale of the Site have been taken in an appropriate and timely manner; and WHEREAS, the City Council has duly considered all terms and conditions of the Purchase Offer and believts that the disposition of the Site pursuant thereto is in the best interests of the City of Orange and the health, safety, and welfare of its residents, and in accord with the public purposes and provisions of applicable State and local laws and requirements,
