RES-8573 Approving General Plan Amendment No. 1-95RESOLUTION NO. 8573 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE UPHOLDING THE RECOMMENDATION OF THE PLANNING COMMISSION OF THE CITY OF ORANGE AND APPROVING THE GENERAL PLAN RECLASSIFICATION OF PROPERTY SITUATED AT 404 TO 490 NORm ORANGE STREET. GENERAL PLAN AMENDMENT 1- 95 CHAPMAN UNIVERSITY RECITALS:After due public hearings as required by law, the City Council of the City of Orange considered a recommendation of the Planning Commission of the City of Orange recommending, by Resolution No. PC 51-95 that certain property situated on the west side of Orange Street, between Sycamore and Walnut Avenues be redesignated from the low-medium density residential designation to the public facilities designation and approved said recommendation after finding and determining the hereinafter described facts. The real property which is the subject of the redesignation is more particularly described as follows:Lots 4 and 5 and the east one-half of lot 3 and all of lots 6, 7, 8, 9, 10, 11, 12, 13 and 14, Block "A" ofW.H.H. Clayton's Subdivision of part of Richland Farm Lot 13, in the City of Orange, as per map recorded in Book 4, page 6 of Miscellaneous Maps,records of Orange County.Upon the public hearing before the City Council, the following facts were established:1. Chapman University is proposing to develop a parking lot to provide additional parking for future expansion plans. The Chapman University campus is generally bounded by Glassell Street to the west, Rose Street to the north, Shaffer Street to the east, and Palm Avenue to the south. Development within this boundary is governed by the Chapman University Specific Plan. The project area, which is currently outside the Specific Plan boundary, includes eleven parcels located on the west side of Orange Street between Sycamore and Walnut Avenues; addressed 404- 490 N. Orange Street.2. The parking lot proposal requires the removal of all structures, landscaping,and utility lines contained on 10 of the 11 properties (the property located at the southwest comer of Orange Street and Walnut Avenue is included in the general plan amendment and zone change request, but will not be redeveloped with a parking lot grading of the site, and the installation of asphalt, hardscape, lighting, landscaping and irrigation. 3. Approval of the following actions is requested: General Plan Amendment 1-95 - Amendment to the City's General Plan Land Use Element to change the existing designation from Low-Medium Density Residential, 6-15 dwelling units per acre, to Public Facilities.Zone Change 1175-95 - Redesignation of 6 parcels from R- 4 (SP), Multiple-Family Residential (Specific Plan), to P-l (SP), Public Institution (Specific Plan). Five parcels are to be redesignated from R-4, Multiple- Family Residential, to P-l (SP), Public institution (Specific Plan).Chapman University Soecific Plan Amendment - Amendment to include the project area within the Specific Plan boundary, and to amend three provisions contained within the Specific Plan, as follows:a) To change City Council Resolution No. 7233, Specific Plan Chapter 3.0 (Development Regulations) and Chapter 5.0 ( Design Guidelines) in order to allow street front setbacks of less than 20 feet along the west side of Orange Street and the north side of Sycamore Avenue for the open parking lot development; specifically to 2' along Orange Street and 8' along Sycamore Avenue;b) To change City Council Resolution No. 7231 and Specific Plan Chapter 3.0 (Development Regulations) to modify the provision regulating the maximum density and location of modular units on the campus; the original request was to allow 6 units north of Walnut Avenue and 6 units south of Walnut Avenue, but was modified at the Planning Commission hearing to include 3 units north of Walnut and 6 units south of Walnut; and c) To waive the requirement contained in City Council Resolution No.7231 in order to allow the Specific Plan boundary to change prior to acquisition of the entire block on the west side of Orange Street; i.e., the project area would be reduced to 10 parcels if the parcel located on the southwest comer of Walnut Avenue and Orange Street is not acquired by Chapman University.4. The Planning Commission considered the project at a public hearing held on November 20, 1995, and recommended that the City Council approve General Plan Amendment 1-95, Zone Change 1175-95, Amendment to the Chapman University Specific Plan, and Mitigated Negative A number of issues were raised at the public hearing that the Planning Commission addressed by either modifying or adding conditions of approval, as follows: 1. Public Notification - A number of people stated that they did not receive hearing notices. The Commission added a condition (condition #12) recommending that the Specific Plan be amended to require the University to hand deliver notices of any future public hearings, to all properties within 300' of the Specific Plan boundaries. Such noticing would be in addition to the notification provided by the City. Subsequent to the hearing, staff rechecked the radius map and mailing list and found that there was an error in the mailing list, that eight properties (out of a total of 229) were not notified. Staff also found that a majority of the people who said they were not notified were on the mAiling list. Staff corrected this omission for the City Council hearing.2. Historic Resources - The Commission added provisions requiring that the University advertise the availability of salvaged historic materials for sale (condition #9)and requiring Chapman University to contribute an amount equal to the cost of demolition toward the cost of relocation of any house bought for such purpose (condition #7). They also asked for additional photo documentation of the block prior to demolition, with photographs to be donated to the Orange Public Library historical archives (condition 10).3. Modular Units - The original application requested modification to the provisions for modular units on campus, to allow an overall total of 12 such units, 6 north of Walnut, and 6 south of Walnut. At the hearing, the applicant stated that the University had a need for only 3 units north and 6 units south of Walnut. There was some concern raised about the future placement of modulars north of Walnut. The Planning Commission recommended that the processing requirements for these units be modified,and that placement be subject to Major Site Plan Review (rather than administrative review) to allow for public input and review (condition #13).4. Traffic and Parking Management - Concerns were raised relative to whether the parking lot proposed for the property being added -to the specific plan would be adequate for future expansion needs. Residents were also concerned that many students seem reluctant to utilize University parking lots and prefer to park on City streets. The University summarized the measures they have enacted in an effort to increase parking lot usage and minimi7e impacts on the surrounding residential area. The Commission acknowledged the difficulty of influencing student parking habits, and recommended that the University work with City Traffic Engineers to develop a traffic management plan to achieve maximum parking lot utilization (condition # 14).SSH:ld Reso. No. 8573 3 In their recommendation to approve the project, the Commission noted that this project is a positive step by Chapman University and is an important improvement to the community. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange that the recommendation of the Planning Commission be upheld and that General Plan Amendment 1-95 redesignated the subject property to the Public Facilities District be approved for the following reasons:1. The Public Facilities General Plan Designation is more appropriate for the proposed use of the property as a University parking lot, than the existing Low-Medium Density Residential designation.2.
