RES-8826 Revising Conflict of Interest Code to Include Audit CommitteeRESOLUTION NO. 8826 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE REVISING THE CONFLICT OF INTEREST CODE FOR THE CITY OF ORANGE TO INCLUDE THE AUDIT COMMITTEE. WHEREAS, the Political Reform Act, Government Code Sections 81000, et seq., requires the City to adopt and promulgate a conflict of interest code; and WHEREAS, the City has complied with this requirement by adopting by reference the standard conflict of interest code developed by the Fair Political Practices Commission as the conflict of interest code for the City; and WHEREAS, the Political Reform Act requires the City to review and revise, as necessary, its conflict of interest code every even-numbered year; and WHEREAS, on July 22, 1997, by adoption of Resolution No. 8802, the City Council of the City of Orange established an Audit Committee, providing that its members are subject to the requirements of the conflict of interest code of the City of Orange and the conflict of interest laws of the State of California; and WHEREAS, Section 87306 of the Government Code requires an amendment to the City's conflict of interest code when change is necessitated by changed circumstances,including the creation of new positions which must be designated pursuant to subdivision a) of Section 87302 of the Government Code; and WHEREAS, the City has determined that the City's conflict of interest code requires revision due to the establishment of an Audit Committee.NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange as follows:Section I:The Conflict of Interest Code for the City of Orange's designated officers and employees shall be as set forth in Exhibit "A", which is attached hereto and incorporated herein by this Section II: Only those employees and officers who are designated in the City's Conflict of Interest Code for the first time are required to file an initial statement as is defined in Section SeA) ofthe Code. No. 8826 2 TJR:dg DISCLOSURE CATEGORIES Category 1 Category I relates to interests in real property within or close (2 miles) to the City of Orange in which the designated employee, spouse and dependent children have an aggregate interest of $ 1,000.00 or more in value. It includes interests in real property held by a business entity or trust in which the employee, spouse and dependent children have an aggregate interest of 10% or greater. Category 2 Category 2 relates to investments held by the designated employee, spouse and dependent children with an aggregate value of more than $1,000.00 in business entities having real property in the City of Orange or doing business, planning to do business, or having done business in the City of Orange within the past two years. It includes investments held by a business entity or trust in which the filer, spouse and dependent children have an aggregate interest of 10% or greater. Category 3 Category 3 relates to sources of income (including loans) aggregating 250.00 or more if the source is located within or doing business within the City of Orange. It includes gifts aggregating $50.00 or more whether or not the source donor) is in Orange. It includes sources of income to the designated employee, community property interest in the income of a spouse and the employee's pro rata share of any income of a trust in which the employee, spouse or dependent children have individually or collectively 10% or greater interest. Category 4 Category 4 relates to employment and management positions in business entities. All interests in real property as set forth in Category I, but only investments, sources of income and business positions which may provide services or materials of the type utilized by the library. Consultants shall be included in the list of designated employees and shall disclose pursuant to the broadest disclosure category in the code subject to the following limitation: The City Manager may determine in writing that a particular consultant, although a designated position," is hired to perform a range of duties that is limited in scope and thus is not required to fully comply with the disclosure requirements described in this section. Such written determination shall include a description of the consultants duties and, based upon that description, a statement of the extent of disclosure requirements. The City Manager's determination is a public record and shall be retained for public inspection in the same manner and location as this conflict of interest code.
