RES-8831 Request to Allocate Combined Transportation Program Funds for Right of Way AcquisitionRESOLUTION NO. 8831 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE REQUESTING THE ORANGE COUNTY TRANSPORTATION AUTHORITY TO ALLOCATE COMBINED TRANSPORTATION PROGRAM FUNDS FOR RIGHT- OF-WAY ACQUISITION ON LAVETA AVENUE FROM LEMON STREET TO ORANGE STREET AND GLASSELL STREET FROM LA VETA AVENUE TO 364 FEET NORTH.WHEREAS, the Orange County Transportation Authority approved a Combined Transportation Funding Program (CTFP) for fiscal year 1996/ 97; and WHEREAS, the programincludes $837,457.00 in fiscal year 1996/ 97 for a Right-of-Way Acquisition project on LaVeta Avenue between Lemon Street and Orange Street andGlassell Street from La Veta Avenue to 364 feet north; and WHEREAS, the City of Orange has adopted a General Plan Circulation Element which does not preclude implementation of the MPAH within its jurisdiction;and NOW, THEREFORE, BE IT RESOLVED that the City of Orange,hereby requests the Orange County Transportation Authority allocate $ 510,284.62 of CTFP funds from the U.P. Program for construction of said project to the City of Orange.This request is in conformance with the CTFP allocation process and does not exceed ninety (90) percent of the programmed amount or ninety (90) percent of the construction contract.BE IT FURTHER RESOLVED, that the City of Orange, agrees to fund its share of the improvement costs of the above indicated fiscal year and any additional costs over the identified programmed amount.BE IT FURTHER RESOLVED, that the City Council of the City of Orange on May 28th 1996, by Resolution No. 8629 has authorized Right-of-Way acquisition for the 1996-97 fiscal year beginning on July I, 1996 BE IT FURTHER RESOLVED, that the City of Orange has: I)designed the project improvements, and 2) completed required preparatory work in accordance with the standards required by the City/County and other affected jurisdictions involved with said project.BE IT FURTHER RESOLVED, that the remaining ten (10) percent in CTFP funds will be transferred to the completed and a Final Report on the project is accepted by the Orange County Transportation Authority.
