RES-8800 Amending Resolution No. 8766 nunc pro tuncRESOLUTION NO. 8800 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING RESOLUTION NO. 8766 NUNC PRO TUNC Section 1: On June 10, 1997, the City Council adopted Resolution No. 8766, authorizing the City to institute legal proceedings to acquire the property located at 205-235 W. La Veta Avenue. The City Council authorized a full take of the property although only a portion of the property was necessary for street widening purposes. The City Council authorized the full take because the property in the after condition would be non-conforming and would create significant vehicle and pedestrian safety issues and could not be developed. The property owners and their attorney were heard extensively on the issue of whether or not the City was entitled to a full take, State law requires that Resolution No. 8766 include a provision stating that the acquisition by the City will result in a remnant and authorizing the City to acquire that remnant. That provision was left out by mistake and Resolution No. 8800 hereby rectifies that mistake nunc pro tunc by amending Resolution No. 8766 to include the finding made by the City Council that a full take is authorized by including the following language: "That the City is authorized bySection 1240.410 of the Code of Civil Procedure to acquire the remnant."ADOPTED this 22nd day of July, 1997,ATTEST:I hereby certify that the foregoing Resolution was duly and regularly adopted by the City Council of the City of Orange at a regular meeting thereof held on the 22nd day of July, 1997, by the following vote: AYES: NOES: ABSENT:ABSTAIN:COUNCIL MEMBERS: MURPHY, SLATER, COONTZ, SPURGEON, ALVAREZ COUNCIL MEMBERS: NONE COUNCIL MEMBERS: NONE COUNCIL MEMBERS: NONE P~ AM-dk& ~~:</.t~City Clerk ofth
