A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF ORANGE UPHOLDING
THE RECOMMENDATION OF THE
PLANNING COMMISSION OF THE CITY OF
ORANGE AND APPROVING THE
SUBDIVISION OF PROPERTY SITUATED
AT THE NORTHEAST CORNER OF
CANYON VIEW AVENUE AND WHITE OAK
RIDGE.

Applicant: Pulte Homes Corporation
RECITALS:
After report thereon by the Planning Commission and after due public hearings as
required by law, and after receiving a recommendation from the Planning Commission,
recommending, by Resolution No. PC 5-97 that the subdivision of property situated
south of the northeast corner of Canyon View Avenue and White Oak Ridge be approved,
the City Council considered Tentative Tract 15398 and determined that the
recommendation of the Planning Commission should be upheld and that Tentative Tract 15398
be approved. Subject property is more particularly described as
follows:Lot 18 of Tract No. 12417, as shown on a map recorded
in Book 558, Pages 32 to 47 inclusive, of Miscellaneous
Maps,Records of Orange County,
California.During the public hearing, the City Council found the facts more particularly
set forth as
follows:1. This project is a proposal to subdivide and develop the last remaining
vacant parcel in Santiago Hills. The proj ect consists of 100 lots, including 97 lots
for detached single family homes and three small remnant parcels that will
be dedicated to the City and made part of the assessment district. The
proposed subdivision and development are subject to, and in compliance with,
the provisions of the Upper Peters Canyon Specific
Plan.2. The Upper Peters Canyon Specific Plan designates this property for
medium density residential development, maximum 15 units per acre, and has a
minimum lot size requirement of 2,400 square feet. The project is designed at a density
of 8.8 units per acre, with a minimum lot size of 3,000 square feet and an average
size of 3,554 square feet. All lots will have a 2 car garage with an 18' long
driveway, and internal streets will be public, allowing parking on both sides.
There are two access points to the tract, one off White Oak Ridge and the other off
Old Camp Road. There are no common areas proposed within the tract; it was the
applicant's intent to spare future homeowners the expense of homeowners
association dues.
3. At the initial public hearing before the Planning Commission, approximately 14
area residents spoke, many expressing concerns with the proposed project. The
Planning Commission also identified concerns and continued the project,
requesting that the applicant consider a number of changes to improve the tract
design. The applicant held a meeting with interested residents and returned to the
Planning Commission with modified plans addressing concerns raised at the
hcaring. The changes included adding a second project entry (only one had been
proposed initially), creating a pedestrian connection to the community paseo,
revising the grading concept and refining lot sizes and shapes. Although the
Planning Commission initially was concerned with the lack of open space within
tract boundaries, they later noted that a central premise of the Specific Plan was to
allow smaller residential lots as a trade-off for greater community open
space,which includes the eight acre public park, the public school site, and Handy
Creek Greenbelt. The Specific Plan also acknowledges the County Peters
Canyon Regional Park as an additional open space amenity easily accessible to
area
residents.4. In recommending approval of the project the Planning Commission found that
the proposal is consistent with the City's General Plan and the Upper Peters
Canyon Specific Plan, that the site is physically suitable for the proposed
development,and that the project will not cause substantial impact upon the environment.
They also found that the revisions to the project adequately addressed their
concerns regarding circulation, access to the community open space and lot sizes
and
configurations.NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City
of Orange that Tentative Tract 15398 be approved for the following
reasons:1. The proposcd subdivision, including its provisions for design and improvement
is consistent with the City's General Plan and the Upper Peter's Canyon
Specific Plan, and is compatible with the objectives, policies and land use specifications
of the Specific
Plan.2. The site is physically suitable for the proposed type and density of
development.3. The design of the subdivision and proposed improvements will not
cause substantial environmental damage, injure fish, wildlife or their habitat,
cause serious public health problems, nor conflict with any easements for public

4. The project has undergone modifications to improve circulation, internal access to
the paseo, and lot sizes and configurations.
BE IT FURTHER RESOLVED that Tentative Tract 15398 be approved subject
to the following conditions:
1. Project shall be developed in accordance with the plans approved by the Planning
Commission and as modified by conditions herein.
2. The applicant shall prepare and submit plans to the City's Design Review Board
for the Board's approval of architectural elevations of the housing units, and for
tract entry treatment.
3. Perimeter fencing shall match existing typical fencing within Santiago Hills.
Existing fencing along streets is tan colored block wall with pilasters, and red
brick cap. Existing fencing along paseos is of see through construction,
consisting of tubular steel panels with tan colored block pilasters and brick cap.
Fencing along Canyon View Avenue and White Oak Ridge shall provide for
sound attenuation per recommendations contained in noise study.
Conditions 4-26 shall be implemented to the satisfaction of the Public
Works
Department:4. Subject to Addendum Sheet No.
1.5. Monuments shall be set based on a field
survey.6. Dedicate and construct streets to City
standards.7. Dedicate and construct sewer and storm drain systems to City
standards.8. Install street lights to City standards. Street light layout shall be subject
to approval by the City Traffic Engineer. All street furniture locations must
provide a clear 48 inch sidewalk area past
obstacle.9. Dedicate Lots A, B & C to the City of
Orange.10. Lots A & B shall be landscaped as reviewed and approved by City's
Landscape Assessment Coordinator. Walls constructed along lots A & B shall be located
at top of slope, totally within private
property.3 Reso No.
11. Fencing of Lot C shall be of see-through construction, consistent with
fencing along the paseo, and shall be located entirely on the adjacent
lots.12. Applicant shall provide details for the proposed surface, landscaping and
fencing of Lot C to the Staff Review Committee for review and approval prior
to installation. Details shall include any proposed ramping configuration
necessary to connect to the
paseo.13. A Final Tract Map shall be recorded within 24 months after tentative approval
and prior to the sale or lease of any
lot.14. Subject to installing cable television facilities as required by City's
Franchised Cable TV companies. This shall include easement rights to buildings
being
served.15. Erosion control facilities shall be installed after rough grading per
approved erosion control
plan.16. Developer shall obtain a National Pollutant Discharge Elimination
System N.P.D.E.S.) permit. No permits will be issued until the City is satisfied that
the project meets all applicable sections of the N.P.D.E.S. permit,
including incorporation of Best Management Practices (
BMP).17. Developer shall dedicate vehicular access rights along White Oak Ridge,
Canyon View Avenue and Old Camp Road, to the City of
Orange.18. Grading and public improvement plans shall provide for adjacent drainage
from Paseo"/community trail area. Paseo shall not drain into Lot
C.19. Entrance street between White Oak Ridge and "c" Street shall be posted for "
No Parking
Anytime".20. Install stop signs, pavement markings and a minimum of 25 feet of
parking restrictions in advance of the STOP signs on the tract exits at White Oak
Ridge and at Old Camp Road, and on Street "A" at Street "B", all to the satisfaction
of the City Traffic
Engineer.21. Sight distance for all corner lots at local street intersections shall be provided
using the corner cut-offs described in Orange Municipal CodeSection 17.36.050(
E) with a maximum height of 36 inches from top of curb for all obstructions.
The sight distance cut-off areas shall be shown on the tract map. A minimum
of25 feet ofred curb markings shall be installed on each side of the
corner curb returns.Reso
21(a). Install double-yellow centerline, raised reflective pavement markers and
required corner lot red curb markings at all street knuckles (three) to the satisfaction of
the City Traffic
Engineer.21 (b). Prospective buyers of all lots in proximity to required parking restrictions,
striping and pavement markings, STOP signs and vision zone height restrictions
as described in Conditions 20, 21 and 21(a) shall be advised of such by
the
developer.22. An on-site dedicated water line shall be installed as designed by
the
Water Department.23. Each lot shall be metered separately unless otherwise approved by
the
Water Manager.24. The developer shall satisfy all counection, plan check, and inspection
charges as determined by the
Water Department.25. The Developer shall satisfy all Irvine Ranch Water District
requirements
and assessments.26. The developer shall submit a copy ofthe final tract map to the Irvine
Ranch
Water District.Conditions 27-32 shall be implemented to the satisfaction
ofthe Fire Department:27. The number and location of hydrants shall be determined by
Fire
and Water Departments.28. Every building shall be accessible to Fire Department apparatus
by an access roadway of not less than 20 feet of unobstructed width having a
minimum of 13 feet 6 inches of vertical clearance. The access roadway shall
be extended to within 150 feet of all portions of the exterior walls of the first
story of any building. U.F.C. Sections
901 and 902.29. All streets less than 36 feet wide shall be marked and sigued as a
fire lane. The marking and signage shall be provided and installed per the City
of Orange Fire Departments
Fire Lane Standards.30. Dead-end Fire Department access roads shall
not exceed 600 feet.31. The Fire Department access roadway shall be
provided with adequate turning radius for Fire Department apparatus. (A 40 foot outside
and 20 foot inside radius.) U.F.C. Section

32. City of Orange Ordinance 3-94 requires all roof coverings to be fire retardant D.
L.listed Class A. The eaves shall be fire stopped and enclosed with
approved material at the eave ends to preclude entry of flame or embers under the
roofing material. Openings into attics, floors or other enclosed areas shall be
covered with corrosion resistant wire mesh not less than one fourth inch, no more than
one half inch in any dimension except where such openings are equipped with sash
or doors. In addition, a spark arrestor is required on chimneys, maximum one
half inch screen
required.Condition 33 shall be implemented to the satisfaction ofthe Police
Department:33. All structures shall comply with the requirements of the Municipal
Code-Chapter 15.52 (Building Security Standards), which relates to the use
of specific hardware, doors, windows, lighting, etc. (Ord. 7-79).
Architect drawings shall include sections of the Ordinance that apply under "
Security Notes". An Approved Products List 8/96" of hardware, windows, etc.
Is
available upon request.34. The resolution for this project will not be effective unless it is
signed by the applicant indicating and acknowledging hislher understanding
of the conditions imposed herein. The failure ofthe applicant to sign this permit in no
way shall be deemed to confer any greater rights than are contained
in this permit.35. By signing and accepting the resolution, the applicant
accepts the benefits conferred by the permit subject to the
conditions imposed herein.36. The applicant agrees to indemnify, hold harmless, and defend
the City, its officers, agents and employees from any and all liability or claims
that may be brought against the city arising out of its approval of this permit,
save and except that caused by City'
s active negligence.37. The applicant shall comply with all federal, state and local laws.
Violation of any of those laws in connection with the use will be cause for
revocation
of this permit.38. Construction traffic shall be limited to access from Old Camp
Road, via Canyon View Avenue and Jamboree Road, subject to review of the
City Traffic Engineer and subject to existing City ordinance and policy
regarding haul routes.The following code provisions are applicable to this project and
are included for information only. This is not a complete list of requirements;
