NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that the City Council of the City of Orange will hold a Public Hearing,
Tuesday, August 10, 2021, at 6:00 p.m. or as soon thereafter as the matter may be heard, in the Council
Chambers, 300 E. Chapman Avenue, Orange, to consider the following request:
SUBJECT: Appeal No. 0556-21 of Planning Commission Resolution No. PC 03-21, a resolution
approving Conditional Use Permit No. 3103-19, Design Review No. 4991-19, and
Minor Site Plan Review No. 0991-19.
PROPERTY LOCATION: 2940 E. Chapman Avenue, Orange, CA
REQUEST: An appeal of Planning Commission Resolution No. PC 03-21, which approved a proposal
to redevelop a former full-service restaurant site with a new 2,460 square foot drive through fast food
restaurant, 610 square foot outdoor dining area, and related site improvements on a 0.53 acre site in the
Limited Business (C-1) zoning district.
PLANNING COMMISSION ACTION: At their May 17, 2021 meeting, the Planning Commission
unanimously voted (5-0) to approve the project.
ENVIRONMENTAL INFORMATION: The proposed project is categorically exempt from the
provisions of CEQA pursuant to State CEQA Guideline 15303 (Class 3 – New Construction or
Conversion of Small Structures) because the project consists of the construction of a new, small (<10,000
square foot in urbanized area) structure zoned for such use, not involving the significant use of hazardous
substances, where all necessary public services are available, and where the area is not environmentally
sensitive.
Nothing further is warranted or required to comply with CEQA. No public review is required for an
exemption.

RIGHT OF APPEAL: Any action taken by the Planning Commission in the administration or
enforcement of the provisions of the Orange Municipal Code may be appealed by any person aggrieved,
or by an officer, commission or department of the City. Such appeals may be made to the City Council.
Any appeal shall be filed within fifteen (15) calendar days after the hearing or action from which the
appeal is made.
All interested persons may submit comments and may be heard on any relevant matter relating to the
